Two Shenandoah, Pennsylvania, Men and Four Police Officers Indicted for Hate Crime and Related Corruption
WASHINGTON – A federal grand jury has returned multiple indictments arising out of a fatal racially motivated beating and related police corruption in Shenandoah, Pa., the Justice Department announced. The three indictments include federal hate crime, obstruction of justice, conspiracy, official misconduct and extortion charges. The indictments were unsealed today, after being returned under seal on Dec. 10, 2009.

The three indictments include federal hate crime, obstruction of justice, conspiracy, official misconduct and extortion charges. INDICTMENT 1: HATE CRIME INDICTMENTS: The first indictment charges Derrick Donchak and Brandon Piekarsky with a federal hate crime for fatally beating Luis Ramirez, a Latino male, while shouting racial epithets at him. (Both Piekarsky & Donchak are now in county prison after being convicted of simple assault and alcohol-related charges for the murder; Walsh testified against them at the DOJ Grand Jury). According to the indictment, on July 12, 2008, the defendants, and others, were walking home from a local festival when they encountered Ramirez. The defendants then attacked Ramirez in a public street by striking and kicking him while members of the group yelled racial slurs at him. Ramirez died two days later from his injuries. The indictment also alleges that, immediately following the beating, Donchak, Piekarsky and others, including members of the Shenandoah Police Department, participated in a scheme to obstruct the investigation of the fatal assault. As a result of this alleged obstruction, Donchak is charged in three additional counts for conspiring to obstruct justice and related offenses. If convicted, Piekarsky and Donchak face a maximum penalty of life in prison on the hate crime charge. Donchak faces 20 years in prison on each of the obstruction charges and an additional five years in prison for conspiring to obstruct justice. "Violence motivated by bigotry and hate has no place in America, and yet it remains all too prevalent in many of our communities," said Thomas E. Perez, Assistant Attorney General for the Department of Justice. "The Civil Rights Division stands ready to bring perpetrators of hate crimes to justice."
INDICTMENT 2: OBSTRUCT JUSTICE INDICTMENTS: A second indictment charges Shenandoah Police Chief Matthew Nestor, Lt. William Moyer and Police Officer Jason Hayes with conspiring to obstruct justice during the investigation into the fatal beating of Ramirez. Moyer has also been charged with witness and evidence tampering, and with lying to the FBI. If convicted, the defendants face 20 years in prison on each of the obstruction charges and an additional five years in prison for conspiring to obstruct justice. Moyer faces an additional five years in prison for making false statements to the FBI.
INDICTMENT 3: EXTORTION & CIVIL RIGHTS INDICTMENT: A third indictment charges Chief Nestor and his second-in-command, Captain Jamie Gennarini, with multiple counts of extortion and civil rights violations. According to that indictment, from 2004 through 2007, Nestor conspired to extort cash payments from several illegal gambling operations in the Shenandoah area and obstructed the investigation of the extortion scheme. The indictment also alleges that on May 17, 2007, Nestor and Gennarini committed extortion by demanding a $2,000 cash payment from a local businessman and his family in exchange for releasing the businessman from their custody. "The power granted to law enforcement officers does not place them above the law. We will continue to aggressively enforce the law to combat obstruction and corruption in law enforcement agencies," Assistant Attorney General Perez said. "We thank the FBI for their work in this investigation." If convicted on these charges, Nestor and Gennarini face maximum penalties of 20 years in prison for each of the extortion counts. Additionally, the defendants face a maximum penalty of 10 years in prison for the conspiracy to violate civil rights.
These cases were investigated by Special Agents Alan Jones and Adam Aichele of the Philadelphia Division of the FBI, and are being prosecuted by Civil Rights Division Trial Attorneys Eric L. Gibson and Myesha Braden.

Luis Ramirez, a small man, was killed by Six Big Football Players, in Shenandoah Pennsylvania in July 2008.
"While the men yelled racial epithets at Ramirez, they punched and kicked his head and body so severely that he lay foaming at the mouth with two skull fractures.
Once Ramirez was on the ground he was continually kicked until brain matter leaked from his skull."

The comments in the Republican Herald are reflective of why Piekarsky and Donchak were able to beat the most serious charges against them.
ReplyDeleteAlso,the color of the shoes that Ariel was unable to identify in court were also mentioned. Moyer had told one of the teens involved to get rid of his shoes.
Perhaps they already had a statement from Muriel about the color of the shoes and the cops were already planning on discrediting her by advising one of the suspects to throw away the shoes.
Cops should be investigating murders, not helping to cover them up! Moyer and Hayes belong in prison for the rest of their pathetic lives.

A Schuylkill County teenager facing a federal hate crime charge in the death of an illegal Mexican immigrant will spend another week in jail. Court officials say Brandon Piekarsky, 18, was scheduled to be released on an assault sentence today.
But prison officials say he must serve another week for an alcohol charge.
Piekarsky was sentenced in June in the beating death of Luis Ramirez, 25, in Shenandoah. Federal prosecutors on Tuesday charged Piekarsky and another teen, Derrick Donchak, with a hate crime related to the beating. They were acquitted of more serious state charges in May.
Shenandoah police Chief Matthew Nestor and two other officers are accused by federal authorities of trying to cover up the beating. Nestor is in jail. The other two officers are on house arrest.
Donchak and Piekarsky are scheduled to appear in federal court next Tuesday.

The federal government has charged three top police officers in Shenandoah, Pa., with covering up evidence in the fatal beating last year of a Mexican immigrant.
Two white football players are in jail now for the attack, although the most serious charges against them were thrown out by a jury.
Federal prosecutors say that's because police officers in the insular town knew the boys and altered evidence in the case. One police officer investigating the case was dating the mom of one of the accused. Another cop had a son on the same football team as the accused.
Prosecutors say the Shenandoah police intimidated witnesses, coached the kids to lie and helped dispose of evidence.
Police Chief Matthew Nestor was charged with additional counts of extortion.

But one Hispanic resident, Carlos Vega, says after living in Shenandoah for 19 years, he still was treated as an outsider.
"Dirty looks, not making any friends, having a lot of trouble in school, my boys," he says.
Five years ago, one of Vega's teenage sons was arrested. About an hour later, he was found hanging in a cell. Vega is suing the police department, including two of the officers arrested this week, claiming that they beat the teenager and made it look like a suicide. No one believed his claims, Vega says, until this week.
"People stopped me in the middle of the block that I don't even know and say, 'Thank you, thank you. Somebody took action on these cops,' " Vega says.
Vega's lawsuit will go to court next summer. The federal charges against the police will get a hearing in the spring. And a small town has a long way to go before its reputation gets any better.

ReplyDeleteI was elated when I heard the news that the Justice Dept. was getting involved. The events in Shenandoah are eerily reminiscent of the Deep South circa 1950!
