Breaking News: Judge Rules Murder Charges Stand in "Kick in the Head" Hate Crime!

The Judge has Ruled! Murder Charges stick and the accused will stand trial together! While the children of Luis Ramirez will still be without their father this holiday season and our hearts go out to them, perhaps JUSTICE will be served afterall!

Judge: Murder charges stand in immigrant beating
Either a sucker punch that knocked down a Mexican man so hard his head bounced off the macadam or a final kick to the side of his head as he lay prone could have caused his death, a Schuylkill County judge has ruled. As a result, third-degree murder charges are warranted against two teenagers who testimony said delivered the blows, according to the ruling by Judge William E. Baldwin. Also, testimony that a third teen kicked Luis Ramirez's head and torso along with the other two -- so hard it could be heard at least 60 feet away-- is sufficient for aggravated assault charges against him, Baldwin ruled. And testimony that the teens joined in a fight that arose from ethnic slurs is enough to support charges of ethnic intimidation against them -- whether or not a specific threat or slurs were attributed to them, the judge ruled.
Baldwin handed down the ruling yesterday in response to a motion filed this month by Brandon J. Piekarsky, 18, Colin Walsh, 18, and Derrick M. Donchak, 19, all of Shenandoah, seeking dismissal of charges in the July 12 beating because of lack of evidence. Baldwin dismissed only a charge of hindering apprehension or prosecution against Donchak, saying prosecutors offered no evidence at the teens' Aug. 18 preliminary hearing or since to support the count. Baldwin also ruled the three should be tried together. Walsh -- the only one of the three to give police a statement detailing what each did, the ruling says -- had asked for them to be tried separately, saying they will have to blame each other for Ramirez's death and would be denied their right to confront their accusers, but Baldwin rejected that. Ramirez, 25, who had lived in the borough six years, died two days after the beating.

    The Judge has ruled the murder charges stick.

    This was a terrible, terrible tragedy. A father is dead. His children will not have him over the holidays.

    These young men with such promising lives are now doomed to go to trial and be judged by a jury of their peers and may serve substantial time in prison for this murder.

    I blame ALL THE HATE GROUPs that convinced these young men that it is ok to hurl racial epiteths at Latinos including, “You F´n Spic”, “Go Back to Mexico,” “Tell your Mexican Friends to get out of town.”

  4. Yes Piekarsky gave the 'last' kick in the fight, however you have been parading him as the 'kick was the killer', Piekarsky was the kicker, murderer. Now it comes out, 'Either, or', and the prosecution has an broad area to paint from. Now they only have to show that due to the hit and/or the kick, Ramirez died. They also have to show intent. I think the judge did the 'right' thing in how he ruled.

  5. What is new news today and what is particularly revelant is that Walsh, one of the 3 indicted, has turned states evidence against the others:

    But now to learn that Walsh provided eye witness testimony is VERY, VERY Significant!

It is my understanding that these kids subscribed to the KKK kind of philosophy and not any groups that were merely opposed to illegal immigration they never stated anything other than the facts in regards to illegal immigration. That doesn't make one a hate group and there is no evidence that these kids were persuaded by those non-hate, pro-American, pro-laws groups.

  9. The articles indicate they were addressing Ramirez as an illegal immigrant even though they did not know him or his immigration status. They shouted racial slurs including "Go Back to Mexico." They called him a "Spic." They sucker punched him. The kicked him in the head after he was passed out, gurgling on the ground.
    At least one of the perpetrators racist and ANTI Immigration views on their myspace accounts.

    And by the Mexican American community which refuses to admit its culpability in supporting illegal aliens and encouraging their presence in this country. By that behavior they contribute to an admittedly bad situation in which innocents become victims of violence. When was the last time this blog reported on the heinous crimes committed by some illegal aliens and Mexican Americans? This is far from the one way street some would have us believe by their repeated reporting of these crimes and not others.

    What are you prepared to do to help? Are you willing to drop your support of illegal aliens? Are you prepared to endorse strict internal enforcement? Are you willing to support secure borders with whatever it takes in the way of infrastructure, staffing and changes in the rules of engagement? Are you prepared to see most of those illegals if their jobs can be filled by American? Are you prepared to support English as the Official language of the U.S.? Positive answers on these questions would show that you are really interested in solving this problem. On the other hand, a negative response would show tht you aren't really prepared to do anything to help reduce the violence.

  16. Just because you haven't read about it doesn't mean that is doesn't happen. It is only reported in the news when a death occurs from it.

    It has been reported that some latino kids have became involved in altercations with black kids on school campuses. Sometimes it is the latino kids that make those remarks and sometimes it is the blacks that have made those remarks. Don't stick your head in the sand. There are just as many racists in minorities as there are among whites.

  20. The charges for Criminal Homicide are just that, they are warranted, however that does not mean that they will be found guilty of it. We won't know that until the trial and its outcome. I have always stated, and I will again, that I 'think' they will end up being found guilty of Manslaughter and not murder, simply because there was no 'intent'. Now can you separate opinion from fact is the question??

    The murder charges stand.

    The witnesses are among the perpetrators themselves.

    The final sucker punch was delivered by Walsh.
    The final kick to the head was delivered by Piekarsky.
    They are the witnesses.
    That is why the Judge formalized and continued the charges.
    You got it now you big dumb guy Liquid??

    Words have enormous power to wound people. I only have to read the last few posts to know this is true. When I first came on this site, I was felt pretty shocked by the attitudes expressed by the ANTIs towards the undocumented. I used the word "racist" and it seemed to really push people's buttons. Now, I live in rather liberal area of the country, so I wasn't used to hearing these types of attitudes towards undocumented immigrants. Most white people I know are very decent people who go out of their way to help their neighbors. They would never think of directing such vitriol at the anyone, whether they are authorized to be here or not. Most of them realize that the people who come here are among the world's poorest people. They don't have much choice because there is often NO work in their countries. Too often, the choice is literally to come to the United States or starve. So the undocumented come here just to survive and help their families survive. They do the hardest work - literally backbreaking work - for extremely low pay. And they are often scapegoated. They live lonely lives, separated from their families. And they live in constant fear. You can't blame this entirely on the elites in their respective countries, because U.S. policies like NAFTA are responsible for devastating their economies.
    They come because there are white folks who are willing to employ them, and because our country has always relied on a cheap labor pool. Many of my students are undocumented. So I am like a tigress defending her cubs. It hurts me to hear them being referred to in derogatory terms. I also have a boyfriend who was undocumented for many years. He came here from Colombia at the age of six. Colombia is the largest recipient of U.S. military aid in this hemisphere and the third largest in the world, after Israel and Egypt - We have spent over $5 billion so far under Plan Colombia. There are over four million internal refugees in Colombia as a result (U.N. figures). Many of these people will end up here in the United States. We are now doing the same thing with Plan Merida in Mexico. At some point, we need to begin to connect the dots between our policies and the immigration issue. Otherwise, we will never be able to solve this issue.

    Now, I love my boyfriend and my students. So I was tempted to get a bit sarcastic at times. I get this from my father (there is a special brand of sarcastic wit that is appreciated by the French, but doesn't go over too well in American culture). I apologize if my words wounded anyone. Please understand that we are not interested in "political correctness" for its own sake. We are asking you to be careful with your words because people are actually being killed, maimed and abused because of all this vitriol that is being stirred up against the undocumented. We all have our own lists of words that wound us. Let's try to refrain from using the words that hurt each other. Let's try to treat all human beings with the respect they deserve. Thank you.

She then applied that percentage to the illegal immigrant population at large. Voila! Instant endemic perversity! This statistical sleight-of-hand, however, withers by employing the very stats she uses. GAO data for 2003 (the most recent year available) showed about 308,000 criminal aliens (legal as well as illegal immigrants) were in American prisons; they constitute about 3 percent of the nation's 12 million illegal immigrants. If only 2 percent of incarcerated illegals committed a sex crime, then it's intellectually misleading to arrive at the 240,000 figure, ¿quĂ© no?

    For the Mexican, a more telling number in determining sexual deviancy amongst an ethnic group is the percentage of criminals arrested for such crimes. So, let's go to the scoreboard: In 2003, (white U.S. citizens) incarcerated for sex crimes represented about 18 percent of all (white U.S. citizens) inmates in state prisons; perverted Hispanics, conversely, made up just 11 percent (strangely enough, the U.S. Department of Justice doesn't keep the same statistics for federal prisons). I COULD NOT FIND ANY STUDIES that discussed these offenses and the profile of the offenders, so I DID the research myself. Additionally, I was not paid for publishing the results.

    The Violent Crimes Institute conducted a 12 month in-depth study of APPREHENDED illegal immigrants who committed sex crimes and murders for the time period of January 1999 through April 2006. OF THOSE APPREHENDED, the study concluded 2 % were
    Sex Offenders.

    Then, based on her own article, this untrained author performed the following calculation:

    12M illegal immigrants in US

    Multiplied by

    2 % (est. sex offenders in study)

    = 240,000


    That would be like saying 10% of all people arrested are sex offenders therefore 10% of the 300M people in our country are 30M are sex offenders.
