Hearings for three in Shenandoah beating interrupted briefly by Latino demonstrators in Pottsville
Chanting by demonstrators from Latino groups temporarily interrupted hearings this morning in the Schuylkill County Courthouse for three Shenandoah teenagers accused in the fatal beating of a Mexican national. About 30 demonstrators were outside the courthouse in Pottsville, but their chanting could be heard inside the courthouse and the hearings were stopped. Sheriff's officials went outside and spoke to the demonstrators, who stopped their chants. Prosecutors say the defendants and another teen who has been charged as a juvenile kicked and punched Luis Ramirez into a coma on West Lloyd Street on July 12.Ramirez lived mostly in Shenandoah since he entered the U.S. illegally six years ago. According to prosecutors: The defendants, some of whom had been drinking, began the confrontation by taunting Ramirez with racial slurs.They continued to yell ethnic insults during the attack and kept beating Ramirez after he was unconscious.Ramirez died two days later in Geisinger Medical Center in Danville.Brandon Piekarsky, 16, and Colin Walsh, 17, were charged with homicide, ethnic intimidation and other offenses. Derrick Donchak, 18, was charged with aggravated assault, ethnic intimidation and other offenses.Charges are pending in juvenile court against another 17-year-old from Shenandoah.

Testifying in a low, mumbly voice, (football player) Ben Lawson said he had been drinking malt liquor in the woods with Walsh, Piekarsky, Donchak and other friends a few hours before the attack. He said he drank two 40-ounce bottles and was intoxicated. Lawson, 17, said the group encountered Ramirez, 25, and a teenage girl in a park. He said another teen, Brian Scully, goaded the girl, saying, "Isn't it a little late for you to be out?"
Ramirez replied in a threatening manner in Spanish. Scully began yelling racial slurs at Ramirez and a fight ensued, Lawson said. He said Ramirez was fighting with Donchak when Walsh ran up and (sucker) punched him in the face. Ramirez fell to the ground and hit his head on the macadam, leaving him unconscious, after which Piekarsky kicked him in the head (fatal blow), Lawson said. The following day, he said, the group met at Piekarsky's house and hatched a plan to lie to police about what happened. "We made up a plan that we we're going to tell the cops that nobody kicked him, that there were no racial slurs, there was no booze, and Brian got hit first," Lawson said.

Also testifying was Elizabeth Schlack of Shenandoah. She said she heard noise and looked out her window. From about 80 feet away, she said, she saw three people kicking a man on the ground. The kicking went on for about two minutes, she said.

What lead up to the sucker punch? You are giving detail that have been placed already into the given situation. How about details to the beginning.

So far, as no greater details have emerged, you are but second guessing to anything that may have actually happened, as the judge is deciding if there is enough evidence against the three to send the case to trial.

It was just reported and I posted the link on the blog. This was NOT a friend of the deceased. It was a friend of the football players, another football player.

The goading part wasn't enough for Ramirez to reply in a threatening manner in Spanish to prompt the boys to insult and subsequently fight him. Rameriz would have done better to keep his mouth shut and continue about his business with the girl back to his house.
This part: after which Piekarsky kicked him in the head (fatal blow), Lawson said. Should have the wording (fatal blow) removed since it is nothing more than your assertion. Your adding to the information is very biased on your behalf, you want fair and equal treatment yet you input biased opinion that has no bearing on the actual case or facts.

It wasn't murder as he was still alive for 2 days after and only died after complications in surgery.

Ramirez was taken to St. Catherine Medical Center in Ashland, then flown to Geisinger Medical Center in Danville, where he underwent surgery for head injuries.
His condition worsened and he died July 14 at 6:38 a.m.
Nobody chased anybody down according to the testimony. More exaggerating on your behalf. Goading of the girl, Ramirez running his mouth, racial epithets, fight, sucker punch, kick in the head, walk away.

Some homicide charges dropped in immigrant death case
POTTSVILLE - Prosecutors today withdrew first- and second-degree homicide charges against two teenagers accused in the beating death of an illegal immigrant from Mexico in a dark Shenandoah park.
But charges of third-degree homicide and aggravated assault were held for court against Colin J. Walsh, 17, and Brandon J. Piekarsky, 16, in the death of Luis Ramirez, 25. The more significant homicide charges were dropped because prosecutors said they didn't have the evidence to support them.
A third teenager, Derrick Donchak, 18, will face aggravated assault charges in Schuylkill County Court. All three teenagers played on the Shenandoah High School football team last year. Donchak was the quarterback.
There was no ruling by a judge at a preliminary hearing today on charges of ethnic intimidation against the teens, all of Shenandoah.
The judge still ordered them to stand trial.

(a) Offense defined.--A person commits the offense of ethnic intimidation if, with malicious intention toward the race, color, religion or national origin of another individual or group of individuals, he commits an offense under any other provision of this article or under Chapter 33 (relating to arson, criminal mischief and other property destruction) exclusive of section 3307 (relating to institutional vandalism) or under section 3503 (relating to criminal trespass) or under section 5504 (relating to harassment by communication or address) with respect to such individual or his or her property or with respect to one or more members of such group or to their property.
(b) Grading--An offense under this section shall be classified as a misdemeanor of the third degree if the other offense is classified as a summary offense. My articles ruling states: There was no ruling by a judge at a preliminary hearing today on charges of ethnic intimidation against the teens, all of Shenandoah.

The only thing I will say in the murderers defense is, I am sure the alcohol contributed to their crimes. Whoever provided them the booze is just as guilty! However their racist views were a big part of it as well.
In the last suburb I lived in, parents who allowed their underage children to drink in their home or any adult providing them liquor are guilty of a felony and jailed!

OK lmj, prove the kick killed him and not that complications arose from the surgery. Until then it is mere opinion. The kick may have caused head injuries, but it has not been proven at all that he kick was what killed him as he did not die at the scene. It could have been numerous injuries he received during the fight. Internal bleeding may have caused a blood clot that was missed during head surgery, thusly causing death. So, until it is determined the actual cause of death, and given as factual testimony, one can only make assumptions, such as your idiotic and stupid drivel. But we all know how you think, if Dee says its a "murder" you (the sheep that you are) flock right to her. So be careful when you expose your biasness, it makes you look ignorant. Until then I suggest you brush up on some law courses and learn how it all works, better yet learn to read and search as to what the actual facts of this case are as presented by the media and court documentation. It had nothing to do with the "Mexican Man" (who was sitting in the park waiting for the girl) as she walked past the group of delinquents. The "Mexican Man" tried to defend her 'honor' by speaking whatever in Spanish which taunted the boys back (all under the age of 18 with the exception of one).

Welcome to the criminal justice system where you are presumed innocent until proven guilty. So please show us where there has been any difficulty in posing accusations and charging these boys? We all believe that Ramirez is dead, you claim it as murder, for which not everybody agrees with your assumption, many believe it was an accident and warrants nothing more than mere involuntary manslaughter. As for the racial "ethnic intimidation", many don't agree with that either, yet we all agree racial epithets were used after Ramirez instigated the fight with his (unknown) Spanish verbal confrontation to the boys.

That all correlates with the known facts, that Ramirez was fighting, knocked to the ground, kicked by the boys, at which point the boys walked away saying racial epithets, Ramirez called his friends that just dropped him off, Ramirez says again something derogatory to the boys, gets knocked out and then kicked by Piekarsky, boys walk away again.

By Liquid’s logic, we cannot blame John Wilkes Booth of killing President Abraham Lincoln. He would ask for proof that the bullet killed him, and to rule out that his death was not caused by complications that arose from the surgery. Until then it is mere opinion. If we carry his logic to the Lincoln assassination, his argument would be that the bullet may have caused head injuries, but it has not been proven at all that the bullet was what killed him as he did not die at the scene. He died nine hours later across the street from the theater at the Petersen House.
That kind of logic is hard to agree with. I tend to agree more with Arizonian, when he says that it wasn't the bullet that killed him, just the massive bleeding. And what caused the massive bleeding? All the witnesses agree that it was a bullet from John Wilkes Booth's gun that caused the massive bleeding. And in our case, all we need to know is who provided the kick in the head?

You miss the whole point A4, Ramirez got beaten, kicked all while he was on the ground, this could have caused internal hemorrhaging, blood clots could have formed, many variables could have taken place as Ramirez did not die until after head surgery. There's no doubt that the kicks to the body and the last punch and/or kick may have caused trauma, there's no doubt that he died, but to contribute it specifically to the kick in the head is ignorance on your behalf. What of when Ramirez was 'sucker' punched, subsequently knocked out and hit the ground where in his head bounced off the ground, this too could have caused the head injury.

Had you been unbiased in your reporting you would have reported, from all the articles, the chronological time frames and actual happenings in the correct order with the actual statements. The 2 minute comment was based on court reports today. It is new news by a 2nd witness. Like I said.
I think, for the sake of all, we need to allow Justice to run its course. Let the courts decide. I am satisfied that the justice system is proceeding (slow) but proceeding.

Luis was illegal, he was in the park with his so call fiancee step-sister, who is gonna have his baby, plus his fiancee was arrested for trying to run her step-sister over with a car, two weeks ago. This is what I think Piekarsky and Walsh will end up being charged with, since the act of the knockout/knockdown final blow rendered Ramirez to hit his head and bounce off of the ground could have caused blunt force trauma and/or the kick by Piekarsky could have also done it. The problem is which was the actual cause of death? or was it both?
Do you now understand what it has been that I have been saying to you all along Dee or lmj? If it was just the kick that did it than Walsh should only be charged with assault and Piekarsky charged with 3rd degree homicide. If it was the knockdown and head on ground that did it then Walsh should be charged and Piekarsky should be charged with 3rd degree homicide.
By your stubbornness of only the kick causing the death than you have condemned only the one for incomplete evidence based on your assertions.

I ask that the courts follow through. I ask the FBI to monitor to make sure they do their job. I know I will be following the case.
Remember, the local police were going to do nothing.
It was not until attention was brought to the case and the PRO community requested the FBI investigate that police finally took action.
Let Justice run its course. Enough eyes are watching that I believe Justice will be served.
I also think the children of the deceased should be cared for and I advocate that Ms. Dillman talk to lawyers and begin a civil case against the perpetrators´ parents (Similar to the Nicole Simpson family´s civil case.) That way the children of the victim will be cared for. I believe the testimony of the brave, honest football player, Ben Lawson, should be sufficient evidence to win the Civil Case for the children of the deceased.

I take it, lmj, you haven't read nor understood anything at all about this case or about what I have stated. You wear ignorance well. Dee's own ignorance by stating only one thing, such as the "kick" is what killed Ramirez is purely speculative on her behalf, when it could have very well been when Ramirez hit his head on the macadam from when Walsh knocked him out. The 2 of you haven't fully read or understood what the facts are, you both are under the assumption that this was a fight about race, just because an "ILLLEEEEGGAAALLLL MESKIN" was involved. The boys are at fault for the homicide, I have not at any time said differently. You and Dee think they MURDERED him because he was an "MESKIN". When in fact all it was was a fight that went to far adn Ramirez died from the AZZ WHOOPIN!!!! So please, show everybody where it is that I am showing bias for these boys, or do I need to point yours and Dee's ignorance out some more since you think you are her knight in shining armor coming to her rescue????

It's moving forward as a charge of 3rd degree HOMICIDE and ETHNIC INTIMIDATION. Murder and Manslaughter both fall under HOMICIDE. The difference being they are 2 different meanings of the word. One, MURDER, is intentional, while MANSLAUGHTER, is another person having died due to the actions of another. Both carry sentences of jail time, the length of time is the difference.

I think we should ALL comment the Bravery of one young man that told the truth! In spite of all the threats and intimidation he received from his peers when they cooked up the cover up plan, he was brave on the stand. He swore on the Bible he would tell the truth and he did. I highly commend the football player who was the eye witness to these deplorable event, Ben Lawson.

The Blunt Force Head Trauma that killed Ramirez was due to the Sucker Punch by Walsh to Ramirez Head and the Final Kick In the Head by Piekarsky. THAT IS WHY BOTH have been charged with 3rd degree murder! (As the AP reported).
What is also very telling is, the court hearing lasted most of the day. The judge heard from all the witnesses and he, the Judge, ordered the Murder Trial for these murderers. (as the AP reported)
ReplyDeleteI would also be interested in hearing what the young 15 year old girl who was initially harassed, intimidated and sworn at by these hoodlum jocks. I am sure her testimony reveals how heinous the attacks actually were!! I wonder if the Prosecutor is waiting for the trial to provide the inside, most compelling view of the events that dark night!
While I do believe Justice will be served, especially since the FBI and ACLU have been called in, I also think the children of the deceased should be cared for and I advocate that Ms. Dillman talk to lawyers and begin a civil case against the perpetrators´ parents (Similar to the Nicole Simpson family´s civil case.) That way the children of the victim will be cared for. I believe the testimony of the brave, honest football player, Ben Lawson, should be sufficient evidence to win the Civil Case for the children of the deceased. The testimony of the 15 year old verbally attacked girl will help too.

As for Lawson, he is to be commended for his testimony, and I think the others will follow suit. Your problem is you are reading to much into what has been said, jumping to conclusions and condemning them unjustly.
Dillman herself has no case, although her children might. But for a case of wrongful death, Ramirez' immediate family would have to file the charges.

But in response to what you are alluding to, If, for any reason, justice is NOT served and the charges are dismissed, (which I do not believe they will be), I believe I would suggest to Ms. Dillman to pursue a Federal case. (The Violent Crime Control and Law Enforcement Act, enacted in 28 U.S.C. § 994 note Sec. 280003)
I do believe the victim´s children do have the basis for a civil case (similar to the Nicole Simpson Civil case) and I recommend Ms. Dillman pursue it regardless of the criminal case. With the brave young man Lawson´s court testimony, there should be more than enough evidence so the children can be cared for when they grow up. Ms. Dillman as their caretaker (mother) may be able to hire a lawyer to represent the victim´s children.
I have not alluding to anything, your satisfaction has nothing to do with anything, all I did was question you, since you are alluding to murder, would you be alright if the jurors came back with a lesser degree than murder, Involuntary manslaughter? Its a simple question since both fall under the charge of criminal homicide. Again, you are the one making the statement of MURDER and that they're guilty of it.
ReplyDeleteAs for OJ's case, Nicole's immediate family (mom and step-dad) filed the wrongful death case, and it had to meet certain criteria in order to continue to court. Each state is different in regards to its wrongful death statutes, PA is not CA. She should check into it, but don't be surprised if she is denied.

ReplyDeleteA white woman was attacked and thrown to the ground a couple of years ago by Latinos in Maywood, Ca during a peaceful protest. Another elderly white woman was hit over the head with a full bottle of water in Baldwin Park by Latinos. An elderly white man got his face all scratched up by a Latina whereby she even lost a nail doing that. It isn't just about politics either, many of those people just hate white people.
Right, violence isn't the answer just because you don't like the color of one's skin or one's politics either.

All I ask is that Justice be served. I want all of us to get along and the Racial Profiling and Racial animosity to stop once and for all.
I also believe we need Comprehensive Immigration Reform. I know OOV disagrees with my perspective on this, but I do respect that fact that he also abhors racial violence.

Just like I think you are wrong in calling it MURDER when the charge is CRIMINAL HOMICIDE!! You are neither the judge nor the executioner, yet you and OOV have deemed these boys guilty without knowing all the facts. You have picked and chosen to paint the picture you wish to be seen. All you have to do is to call it what it is, CRIMINAL HOMICIDE, let the courts decide the guilt.
Why no outrage over the acts of racial violence on the part of the "brown" people that I posted, dee? Of course, no one was killed in those particular incidents but not even a peep out of you about them.
