Republican Tea Party Russell Pearce's Friend, Neo Nazi J.T. Ready, Murders Family and Baby Latina Girl Before the Coward Kills Himself!

Republican Extremists, Right Winger, TeaParty Minutemen -- KILL Latino children. -- My long time readers know this. They remember little Brisenia Flores who was viciously murdered by Shawna Forde and Gunny Bush.

Now we find that another vicious extremist, J.T. Ready (37), has murdered another small Latina child who he claimed was "half ugly" due to being "half Mexican." Yesterday afternoon, as Lisa Mederos was reporting Ready's violence to a 911 operator, Neo Nazi Minuteman Border Vigilante J.T. Ready, viciously murdered 16 month old Lilly Mederos, her mother, her grandmother and her mother's boyfriend. Then Ready, the evil, murdering coward, turned the gun on himself to escape punishment. The shots can be heard on the 911 tape.

This crime is awful! Neo Nazi, long time friend of the recalled Russell Pearce, murdered this family, all because his "girlfriend", grandmother Lisa Mederos (47) was trying to kick him out.
The police in Gilbert, AZ, are very familiar with the murder location. The police were frequently called to this residence for the domestic abuse Ready frequently inflicted on this family. They wanted to get rid of the slime. The leach refused to leave, then he killed them.
JT Ready was a Border Vigilante. Many in the Immigrant Community believe Ready and his cohorts murdered hundreds of unresolved Border Murders.
Russell Pearce is doing his best to distance himself from the evil Ready, but it's too late Russell. The web has ALL of the pictures of you hugging Ready during your very evil Tea Party and Minutemen Rallies. It's ALL ON THE NET. You can run, but you cannot and will not HIDE from them! Thanks to the Internet, your Evilness and Connection with Evil will LIVE ON FOREVER!!

Guest Voz - David Holthouse: Dangerous Levels of Overlap Between Xenophobic 'Minuteman' Movement and Tea Party

Last August, more than 600 right-wing activists gathered for a Tea Party Nation rally on private land near the U.S.-Mexico border in Cochise County, Arizona. Fluttering in the desert breeze were hundreds of tiny American flags attached to a border fence of 15-foot-tall rusty poles. Rally speakers included Tea Party candidates for the U.S. Senate and House of Representatives, as well as marquee names from Arizona's anti-immigration movement. The headliner was Maricopa County Sheriff (and Fox News favorite) Joe Arpaio, the swaggering lawman whose ski-masked deputies terrorize suspected "illeegals" in controversial roundups, and whose idea of a good photo-op is the forced march of shackled Latino inmates down a city street. Arpaio shared the stage with Arizona State Sen. Russell Pearce, the chief architect of Arizona's infamous Senate Bill 1070. "We have an invasion going on that's going to destroy this Republic," Pearce said. "USA!" came the chanted reply. "USA!"

Grinning on the sidelines behind mirrored sunglasses was Glenn Spencer, the leader of the border vigilante group American Border Patrol and the owner of the Tea Party Nation rally site. Spencer's founding of American Border Patrol in 2002 pre-dated the first Minuteman "civilian border patrols" by three years. Before his ranch land became a Tea Party rallying point it served as both meeting grounds and temporary housing for high-ranking members of various border vigilante factions. Minutemen American Defense leader Shawna Forde lived on the property in an RV owned by Spencer in the summer of 2008. The following May, Forde masterminded the home invasion murders of a 9-year-old girl and her father in Arivaca, Arizona. Two weeks after the slayings, a SWAT team arrested Forde on murder and conspiracy charges as she was leaving American Border Patrol headquarters.

Spencer informed Media Matters that he travels almost weekly to speak at Tea Party events, and that his ranch, the onetime vigilante outpost where Forde took shelter, is now a Tea Party rallying point. "Plans are for Tea Party groups to come to the ranch every week from now on," he said. "They are really fired up over the border issue." Despite his association with Forde and his well-documented history of bigoted ranting and "reconquista" conspiracy mongering, Spencer is a rising star in the Tea Party movement. He's not alone.

Over the past two years, more than a dozen former border vigilante leaders have taken on key roles in the Tea Party movement. Some, like Spencer, continue to maintain their hardcore nativist personas. Others have sought to separate themselves from their Minutemen identities in pursuit of mainstream political legitimacy.

"The Forde killings really made the whole movement sordid and these guys [Minuteman leaders] needed to find somewhere else for their ambitions," said Heidi Beirich, co-director of the Southern Poverty Law Center's Intelligence Project, which tracks extremist groups. "Rebranding themselves as Tea Party figures is their effort to stay relevant. They saw the rising populism as a good thing to latch onto, so they just toned down their anti-immigrant messaging a bit and synced themselves with the larger Tea Party agenda."

Justice for Brisenia: Minuteman Shawna Forde's friend Gunny Bush received Death Penalty!

Immigration Clearinghouse reports: Arivaca Minuteman Murders - Two down One to go - Jason Bush received Death Penalty Not that there was any doubt, but Jason Eugene Bush, Minuteman Shawna Fordes trigger man in the 2009 Arivaca home invasion murders, received the death penalty yesterday by a Pima County jury for the murder of 9-year-old Brisenia Flores and her father Raul. In what has been a very swift yet bizarre trial, on March 25, jurors convicted Bush of two counts of first degree murder, attempted first-degree murder of Gina Marie Gonzalez, one count of burglary in the first-degree; one count of aggravated assault, serious physical injury; one count of aggravated assault, deadly weapon/dangerous instrument; one count of armed robbery; and one count of aggravated armed robbery. (The same charges as Minuteman Shawna Forde was convicted of.) Bizarre in the fact that defense attorneys Richard Parrish and Chris Kimminau never gave opening nor closing statements in the case, instead conceding Bush’s guilt from the gitgo. When it was all said and done, it took the jury less than two hours to find Bush guilty as charged and in the aggravation phase of the trial, the jury returned after only 15 minutes of deliberation finding that Bush was eligible for the death penalty. Factors in that quick decision included the crimes were committed in tandem with other felonies and a minor younger than 15 was one of the victims.

The mitigation phase of the trial, where defense attorneys sought to make excuses for Bush’s action and spare him the death penalty, through testimony from witnesses for hire and Bush’s parents who apparently gave up on him at an early age, was not successful. Defense attorney’s even tried to lay the blame back on prosecution witness, mother and wife of the victims for a victim impact statement she made saying, “I went to bed in heaven and woke up in hell.” They also tried for a mistrial based on some of the statements Gonzalez made, a motion denied by presiding Judge John S. Leonardo. Parrish told the jury, “Some things have to be said about this case that nobody’s had the guts to say.” What he was referring to was revealed shortly afterwards when he continued; “Gina Gonzalez said to you that she went to bed that night in heaven and she woke up in hell. She had a drug dealer husband. She was living in a trailer in Arivaca on five or 10 acres. There was a loaded assault rifle in the nook of the front door. There was a loaded .40 caliber Smith & Wesson pistol near the stove. She knew enough to take that .40 caliber weapon, pull back the slide, undo the safety and shoot at somebody.” Prosecutor Rick Unklesbay, who has been outstanding in the presentation of the prosecution’s case in this trial and the Forde trial that preceded this said; “It’s astonishing and offensive that a defense attorney would stand up here and say that they are not worthy of having the law applied equally to them,” And he was correct. Defense attorneys also accurately suggested that had it only been Raul Flores that was murdered, there wouldn’t have been a trial. Something we have alluded to from the beginning. So it goes in Arizona where the life of a Hispanic is considered worthless by some. He was of course insinuating that the lives of Raul and Brisenia were basically without value because of who they were and the situation they lived in. It took jurors less than 4 hours of deliberation over two days to come to their decision. Bush showed no reaction other than his normal “deer in the headlights look” he’s had throughout the trial at sentencing this morning. Two down, one to go as Albert Gaxiola goes on trial on June 1, 2011. There is no reason to expect any different and outcome as strong evidence also ties Gaxiola to the crime. For more in-depth coverage, check out Rickers Radar Screen which has some pretty decent first person coverage of the trial and it’s players. In particular, following in the footsteps of Laine Lawless, is the report of Jason Bush’s brother Dan, contacting Ricker suggesting there was money to be made for both of them, as he had the “lowdown” on things people couldn’t imagine about his brother. Looking at the photo of Dan with an assault weapon in hand, one can only imagine…………………. Don’t know about y’all, but a 60 day break until the next and final trial is needed for all of us. This afternoon, Bush will be taken, as was Forde, to Arizona’s death row, where he’ll reside for the next 15 or 20 years while his appellate lawyers try to save his worthless axx.

GUILTY! MINUTEMAN JASON "GUNNY" BUSH GUILTY OF MURDERING 9 YEAR OLD BRISENIA FLORES AND HER DAD!

GUILTY! A Pima County Superior Court jury found Minuteman Jason "Gunny" Bush GUILTY of murdering 9 year old Brisenia Flores and her Dad. On May 30, 2009, Bush, the 36-year-old friend of Shawna Forde, murdered 9 year old Brisenia by shooting her twice, at point blank range in the face, as she pleaded for her life.

The jury found White Nationalist Bush guilty on 2 counts of first degree murder, a count of burglary in the 1st degree, one count of attempted first degree murder, aggravated assault, aggravated assault with a weapon, armed robbery, and aggravated robbery. Jurors now will determine whether 36 year-old Bush is eligible for the death penalty and eventual sentencing.

Bush also faces two murder charges in Washington: second-degree murder in the July 1997 fatal stabbing of Hector Lopez Partida, 29, in Wenatchee; and first-degree murder in the September 1997 shooting death of Jonathan Bumstead, 18, in the Palisades area.

BREAKING NEWS: SHAWNA FORDE GET'S DEATH SENTENCE FOR MURDERING BRISENIA FLORES & HER DAD!

The Jury has announced its verdict! Minutemen Group Leader Shawna Forde has been sentenced to death for plotting a deadly home invasion that murdered 9-year-old Brisenia Flores and her Dad. A Pima County jury deliberated just four hours over two days before deciding Shawna Forde, 43, should join the other two women on Arizona’s death row.

Hopefully, this harsh sentence will deter others from even contemplating the thought of such vicious, vicious HATE Crimes!
We never want to see such HATE Crimes happen again!

Meanwhile, Minutewoman Shawna Forde continues to be non-repentant for her crimes!

To Bill O'Reilly: "YOU LIED!" About Brisenia Flores' Citizenship and the Shawna Forde Murder Trial! BOYCOTT FOX NEWS!!! BOYCOTT O'REILLY!

Will we NEVER get Justice for Nine Year Old Brisenia Flores???
Bill O'Reilly LIED!!!! Nine Year Old American Citizen Brisenia Flores is called an "Illeegal" by the Hate-Filled O'Reilly! Shameful! Boycott O'Reilly! Boycott Fox News!!!
C&L Reports:
Of all the media entities that have ignored the case of Shawna Forde and her killer Minutemen, the silence at Fox News has been the most egregious and noteworthy -- particularly because Bill O'Reilly is fond of criticizing other news organizations for supposedly "ignoring" stories that he has deemed eminently newsworthy (even if, in fact, they haven't really ignored them at all, or it's in fact a story of dubious veracity). So naturally we were pleasantly surprised when O'Reilly began tackling the Forde case last night with his panel of legal "experts" -- and, to no one's great surprise, it was nothing but a pack of lies, disinformation and grotesque distortions, from start to finish. For instance, here's O'Reilly's opening, having just discussed yet another case of an "illegal immigrant" having committed a murder, one of O'Reilly's favorite schticks:
O'REILLY: Now -- exact opposite on the political spectrum, in
Arizona. A woman member of the Minutemen breaks into an
illegal alien house?
GUILFOYLE: Right.

No, that's wrong! Both Raul Junior Flores and his 9-year-old daughter, Brisenia (as well as Gina Gonzalez, the girl's mother) were American citizens, born and raised in Arivaca. And from a factually false opening, it goes rapidly downhill: Both Guilfoyle and Wiehl begin trading in even more factually wrong characterizations of Forde and her relationship to the Minuteman movement. Guilfoyle was perhaps the worst:

GUILFOYLE: This woman has some, um, problems otherwise. This wasn't really about immigration -- this was a woman who is a criminal, was working with this group to do drug ripoffs.
O'REILLY: She's a criminal herself.
GUILFOYLE: Yes. The organization she belonged to was Minuteman American Defense, otherwise known as MAD. But I did a lot of research on this case, and essentially she was using this organization to say, 'I'm gonna do rip-offs of drug cartels to fund my group.
O'REILLY: Ohhh, so she joined the group to find out where illegal aliens who might be dealing narcotics.

Wiehl at least points out that Forde didn't join MAD -- she founded it. But that's the least of the issues here: What's more important is that in fact this case had everything to do with immigration, which was the entire fuel motivating Forde's radicalism: She saw herself as a Minuteman "willing to take it to the next level" -- and she was using the drug money to do that.

Indeed, as we reported early on, she intended to metastasize MAD with the money so that it became a kind of super-militia whose larger purpose was to take on the federal government, not just over immigration but a whole panoply of related "Patriot" movement issues. This wasn't about ordinary criminality: It was about right-wing radicalism. As Tim Steller at the Arizona Daily Star reported back then, she was talking to a lot of people about her plans for the group:

Accused ringleader Shawna Forde told her family in recent months that she had begun recruiting members of the Aryan Nations and that she planned to begin robbing drug-cartel leaders, her brother Merrill Metzger said Monday in a telephone interview from Redding, Calif.
"She was talking about starting a revolution against the United States government," he said.
In any event, at this point things in the O'Reilly Factor discussion became nothing but a farrago of falsehoods:

WIEHL: She was kicked out of two other organizations.
O'REILLY: Oh, she got kicked out of the Minutemen?
WIEHL: Well, that was the point. She was such a nut that she was kicked out of Minutemen. She started her own organization.
O'REILLY: All right, so her scam was, she would enter suspected drug dealers' homes and steal their drugs.
WIEHL: She thought he had $4,000 bucks in drug money, she wanted to go in there and get that money with her two accomplices.
O'REILLY: She killed how many people?
WIEHL: She killed the man, she killed the 9-year-old child --
O'REILLY: She killed a 9-year-old.
WIEHL: Yes. The mother of the 9-year-old was on the phone --
GUILFOYLE: She was present, she wasn't the shooter.
O'REILLY: Now, does she get the death penalty? Has she been sentenced?
GUILFOYLE: She is now eligible for the death penalty. The jury is considering it. Her defense at the time was, 'It wasn't me. It was the girlfriend of one of my codefendants.'
O'REILLY: But it doesn't matter, because she was convicted of the murders.
WIEHL: Right.
O'REILLY: So she's gonna go. All right, so then, uh --
GUILFOYLE: And she should -- and the Minutemen organizations don't want any association with her.
O'REILLY: And we want to emphasize that she was kicked out --
WIEHL: She was not part of the Minutemen.
GUILFOYLE: One of them, she was kicked out within 40 minutes of attending her first meeting!
WIEHL: She lied, she said she was leader, she wasn't any of those things.
O'REILLY: So she covered her own stupid organization as a cover for her own criminal activities.
GUILFOYLE: That's correct.
O'REILLY: Then she got what she deserved.

Both Wiehl and Guilfoyle are simply lying here: Shawna Forde was a significant figure in the Minuteman movement in Washington state for the better part of two years before she headed to Arizona. She appeared onstage in Everett with Minuteman Project cofounder Jim Gilchrist at a big Minuteman rally in 2007, and appeared on a public-TV town hall as a spokesman for both the Minutemen and the Federation for American Immigration Reform, which later -- much later -- repudiated her as their spokesman.

Though Media has Ignored Brisenia Flores' Murder by Minutemen, Shawna Forde's Death Sentence will Force it to the Headlines!

To date, the mainstream media (MSM) has ignored 9 year old Brisenia Flores' Murder. Sure, an occasional story or two has made its way through. However, think of the coverage the MSM provided to:
1. Jon Benet Ramsey
2. Natalie Holloway
3. Caylee Anthony
Nancy Grace was relentless in her coverage of these stories, day after day, month after month, year after year. Where was Nancy Grace on this story? Where was Fox news? Where was the majority of the MSM?
Hiding! Hiding, afraid to print this hot, sizzling story. Think of the headlines: "Crazed Minutemen Murder 9 Year Old Mexican American Girl and her Dad!"

Remember the 911 call by Brisenia's brave mother, Gina? She lay shot on the ground, feigning death, waiting until the savage murderers slithered away. Brutally shot, she bravely called 911, hoping in vain she could save her family. During the 911 call, the cowardly gunman returned, not expecting brave Gina to defend her family and shoot back. This, ALL caught on the 911 call recording. Where was the MSM?

The evil perpetrators, these Minutemen leaders, caught on the property of their comrades by the FBI, pictures and video all available. Where was the MSM? The perps were caught. Their connections identified. Where was the MSM?

Even now, throughout the trial, the blame is clear! The jury was quick to convict. The death sentence looming. Where is the MSM?

They were QUICK to jump on false stories. Remember Deputy Louie Puroll's fake shooting? Puroll FIRED by Sheriff Babeu for LYING? Remember Rancher Krentz's murder? No one even knows who shot him. Yet the MSM was everywhere for these stories! Quick to jump on the ANTI Bandwagon blaming the faceless "Illeegals" for these crimes and allowing this excuse to be used in pushing forward Arizona's sb1070 racial profiling bill.

Sitting around the water cooler with some new friends of mine, we started talking about the President. Half the group was liberal. The other half conservative. One liberal turned to me and said, "I think the President is right of center and we are finally seeing his true self, his true agenda." He knew I was a supporter of the President, but I responded, "I know one thing. He certainly has not addressed my main agenda item." He asked, "What is that?" I said, "Comprehensive Immigration Reform." Everyone stopped talking and turned to me. The right winger said, "Amnesty? You want Amnesty again?" They all shook their heads. I responded, "I said Comprehensive Immigration Reform. I want the Hate Crimes to stop! I want the Racial Profiling to stop! I want the Immigration Reform discussion started! And I certainly DO NOT support Mass Deportation! Do you?" Everyone shook their head.

Perhaps we will owe the remorseless murderer Shawna Forde one small thank you! When the Jury finally gives her the Death Penalty for these heinous murders and her story is finally all over the headlines, perhaps then, FINALLY THEN, the Conversation about Comprehensive Immigration Reform can finally BEGIN! Only then will Brisenia Flores finally receive some sort of Justice!

Guilty MinuteWoman Shawna Forde says "I am not sorry!"

Convicted murderer/Minutewoman Shawna Forde said, in an interview with the Daily Beast after her conviction, "I am NOT Sorry!"
Forde remained calm when she listened to the verdict, even though the murder charges could lead to a death sentence in a state that does not shy away from executions. The 43-year-old former child burglar, mom, beautician, and self-professed Minuteman from Everett, Washington, kept her composure, because, (as she told The Daily Beast in an exclusive post-verdict jailhouse interview), “you can’t freak out with the whole world watching you.”

Forde said she was "extremely saddened by the verdict" NOT because of the deaths/murders of an innocent child and her dad, but "because she wanted to set the jury straight on her Minuteman group, which “runs recon missions” and DOES NOT sit on lawn chairs." (As the prosecution witnesses testified.)

On Tuesday, the jury will hear aggravating and mitigating circumstances surrounding Forde and her crimes, and will then decide whether Forde should be put to death.

From Immigration Clearinghouse:
Jurors were asked to consider if Forde;
1.Killed either victim;
2.Attempted to kill either victim;
3.Intended to kill either victim; or
4.Was a major participant in the crimes that resulted in the deaths of either of the victims.
It took the jurors only 45 minutes to come to the unanimous conclusion, that yes, Forde was a major participant in all 4 actions described.

In addition to the above, the jurors were asked to consider the aggravating 4 circumstances of the crime.
They were:
1.The defendant has been convicted of another offense in the United States for which under Arizona law a sentence of life imprisonment or death was imposable.
2.The defendant has been or was previously convicted of a serious offense, whether preparatory or completed. Convictions for serious offenses committed on the same occasion as the homicide, or not committed on the same occasion but consolidated for trial with the homicide, shall be treated as a serious offense under this paragraph.
3.The defendant committed the offense as consideration for the receipt, or in expectation of the receipt, of anything of pecuniary value.
4.The defendant was an adult at the time the offense was committed or was tried as an adult and the murdered person was under 15 years of age, was an unborn child in the womb at any stage of its development or was seventy years of age or older
The jurors found Forde culpable of the first three in regards to the murder of Raul Flores and in all four in regards to the death of nine year old Brisenia Flores.

These findings triggered phase three of the trial.
PHASE THREE
This is the mitigation or penalty phase of the trial as some call it. The burden of proof rests on the defense to show why Forde should receive a sentence of life in prison, with or without parole. This is where the defense will offer excuses as to why Fordes life should be spared. This effort could last until the end of the week as they bring in witnesses to testify about Fordes early childhood, her alleged mental problems, drug use and other excuses they hope will sway the jury into deciding Forde deserves a life sentence instead of the death penalty.

Should this be their decision, then presiding Judge John S. Leonardo will have to decide whether to sentence Forde to “natural life” in prison without parole, or life with a possibility of parole after 25 years.

A decision could be rendered as early as Friday but we expect sentencing to be delayed until Monday or Tuesday of next week.

CONVICTED! Minute Woman Shawna Forde Finally Convicted for Brutally Murdering 9 year old Brisenia Flores and her Dad!

FINALLY.....JUSTICE FOR BRISENIA: A Pima County jury has finally convicted Minute Woman Shawna Forde today of two counts of first-degree murder in the May 30, 2009 murder/deaths of Arivaca residents 9-year-old daughter, Brisenia and her Dad. The jury also convicted Forde of attempted first-degree murder in the shooting of Brisenia's Mom, Gina Gonzalez, as well as related aggravated assault and robbery counts. Brisenia's Mom Gina started crying as soon as the first GUILTY verdict, the killing of her daughter, was read just before noon in a packed courtroom at Pima County Superior Court.

The jury deliberated for seven hours over two days. Jurors will now be asked if the death penalty ought to be considered. On the first day of the trial, which has gained national attention, BRISENIA'S MOM testified her husband woke her to say the police were at the door. The woman at the door (Shawna Forde) identified herself and the man with her as law enforcement officers looking for fugitives, Gina said. When her husband questioned the veracity of their story, Gina said the gunman opened fire, shooting her husband and her. As Gina played dead on the floor, the gunman fired two bullets into their youngest daughter, Brisenia's head, despite the little girl's pleas. Thankfully, their other daughter was spending the night at her grandmother's house. Moments after Forde, Gunny Bush and their two accomplices left, Gina testified Shawna Forde returned to find Gina on the phone with 911 and called out to Gunny Bush to finish Gina off. Gina said she fled to the kitchen, armed herself and fired back when the Minutemen tried to kill her again. Gunny Bush then fled.

Forde, Gunny Bush, 36, and Albert Gaxiola, 44, were arrested within two weeks of the slayings. Forde, Gunny Bush and Gaxiola are scheduled to go to trial March 15 and June 1, respectively.

Day 7 Shawna Forde Murder Trial – Prosecution Rests, Defense mounts bumbling attempt to insert alternate suspect

Guest Voz - Porter Corn - Immigration Clearinghouse:
Day 7 – Shawna Forde Murder Trial – Prosecution Rests, Defense mounts bumbling attempt to insert alternate suspect
As expected, the prosecutors in the capital murder trial of Minuteman Shawna Forde rested their case this morning. Defense attorney charged in rebutting the prosecutions evidence try to say that Gina Moraga, girlfriend of Albert Gaxiola was the woman Gina Gonzalez saw, instead of Shawna Forde. All evidence presented offered so far puts Shawna Forde right in the center of the “donut hole” described by Eric Larsen in his opening statements.
Kim Smith picks up the story:
Jill Thorpe and Eric Larsen have repeatedly shown witnesses of Gina Moraga and asked for their descriptions of her (like the female home invader, short, brownish blonde hair). But, today Thorpe had Detective Juan Carlos Navarro read some texts with the word “Gina” in them.
On May 30, at 7:02 p.m. someone using a phone shared by Gaxiola and Moraga texted Forde’s phone. The message was “How you all hanging? Get your rest and gather strength Red on med leave Have next target intel Will need 4 man team details when we meet Gina”

Five minutes later, there’s a text about dropping off the keys to Forde’s Honda Element, which is in Tucson. The text reads “Pima & Craycroft Have them call when arrive will meet Gina”
Thorpe and Larsen will argue the texts were signed “Gina”, as in Gina Moraga. The state will likely argue the texter is Gaxiola and he’s telling Forde and Bush they’ll be “meeting Gina.”
This phase of the trial is almost over. Faster than anyone could have predicted.

Today is the last day of testimony until next Tuesday. Jurors have been sent home until then.
When they return, Larsen and co-counsel Jill Thorpe will be calling Byron Easter, a neighbor of Gaxiola’s and the other Colorado Minuteman and FBI informant, Robert Copley to testify.
Wednesday will be another day off for the jurors as attorney’s put their heads together to formalize final instructions Judge John Leonardo will give the jurors.

Thursday, defense will call a pay for play memory expert who will try to destroy victim Gina Gonzalez’s testimony. Prosecution will call and question any rebuttal witnesses with closing arguments from both sides to follow.
It’s possible Thursday evening, jury instructions will be given and the case turned over to the jurors.
When the jury returns their conviction, the second phase of the trial will begin. The mitigation phase.
There, prosecutors present evidence of aggravating circumstances that they believe will show Forde deserves the death penalty. The defense will present mitigating factors, or the “po’ little ol patriotic me” coming up with off the wall excuses as to why Forde committed the crimes and why she should be spared the death penalty.

The final phase will be the punishment phase, where the sentence will be decided. Life in prison without the possibility of parole or the death penalty.

Days 5 & 6 - Shawna Forde Murder Trial

Guest Voz - Porter Corn - Immigration Clearinghouse:
Feb 01Day 5 – Shawna Forde Murder Trial – DNA conclusively ties Forde gang to Arivaca murders
Week 2, Day 5 of Minuteman Shawna Forde’s murder trial is in the books and testimony from Scott Walton of Sorenson Forensics conclusively links Shawna Forde, as well as her two cohorts to the murders of Raul Flores and 9 year old Brisenia Flores.
THE DNA EVIDENCE
•Shawna Forde’s DNA matched DNA found on a silver ring stolen from Flores’ wife that was recovered from the Honda Element that Forde was driving at the time of her arrest
•Jason “Gunny” Bush’s DNA was found on camo clothing and hiking boots seized from Albert Gaxiola’s house, blood found in the teal van seen cruising the Flores residence the day before the murders, on a shotgun taken from Gaxiola’s house and from blood found outside the Flores home.
We’ve already had verbal testimony from Chuck Stonex and Oin Oakstar tying the trio to the crime, but nothing like real scientific evidence to drive the point home.
COLORADO MINUTEMEN/FBI INFORMANT TESTIFIES
Ron Wedow, a member of the Colorado Minutemen, another border vigilante group and an FBI informer also took the stand to recount his encounter with Forde. According to David Ricker who is covering the trial as a stringer for the local papers,
Wedow testified that Forde was looking for a specialized team. “She wanted to know if I had a team that could go down there and take this house down,” he said. “The family was a front.”
FBI INVOLVEMENT
At the meeting, Wedow said Forde talked about the potential money they might find at this home in Arivaca. “She talked about millions of dollars being kept there,” he testified. “She said that at any given time there were $2-3 million in the house. After the house was secured her team would take the drugs, money and guns and they would meet at a later time.”
When Wedow questioned Forde regarding his source of information Forde assured him her information was solid. “She told me she had it under surveillance,” he said. “She started talking about drugs money and home invasions. I let it roll from there.”

RECORDED CALLS
After learning about the May 30, 2009, home invasion at the Flores home Wedow contacted the FBI to share his information. In response, the FBI asked him to call Forde on June 2 and June 9. Those recorded phone calls were played for the jury. Wedow asked Forde if she knew anything about the Flores home invasion. “I don’t know shit about that,” Forde said on the call. “If the cops want to talk to me they can call me.”
There was also testimony about a map Forde had drawn that for some reason was destroyed once it was in FBI custody according to the testimony of FBI Agent Chris Andersen. Anderson could give no reason why the sketch was destroyed and under questioning by defense attorneys, said no other evidence had gone missing, to his knowledge.
What wasn’t discussed is why the FBI failed to respond reports by Wedow of Forde's planned activities until after the murders, and then, requested the help of their informants.
Sources also have confirmed that the testimony given by FBI informant and Colorado Minuteman Ron Wedow and reported by David Ricker matched perfectly with information given last year in a series of confidential interviews.
PROSECUTION COULD REST BY END OF WEEK
This is just our opinion and nothing more, but it would appear the prosecution is nearing the end of it’s presentation and will rest by the end of the week.
Most of the witnesses have been called and have testified.
===========
Day 6 – Shawna Forde Murder Trail – Final Prosecution witnesses presented before State rests case
The final day of testimony in the Shawna Forde murder trial before the State rests it case and the defense attorneys begins their rebuttal, was filled with testimony of detectives who caught the case.
Pima County Sheriff’s Department Det. Charles Garcia told jurors of his initial contact and interviews with victim Gina Gonzalez including the photo lineup of six suspects, Forde among them. Garcia stated Gonzalez seemed fixated on the photo of Forde.
Det. Christopher Hogan testified he was on stakeout duty of a motel in Tucson where Forde had been staying and recounted seeing Forde and Gaxiola together at the motel on June 10, ten days after the murders in Arivaca
Det. Paul Montano testified he was part of the take down team who arrested Forde in Hereford, Cochise County and used Forde’s cell phone to send Gaxiola a message to meet her at a McDonalds where he was arrested.
These were witnesses that provided a continuation of the events leading up to the arrest of Forde and Gaxiola. The star of the day, if you could call it that was lead investigator Juan Carlos Navarro.
Detective Navarro testified of notebooks and other papers recovered during a search of Albert Gaxiola’s home in Arivaca, One entry read, “Green light Jr.” on it. The same sheet of paper also said “Truck (Him) and Hummer (Her).” Raul drove a pick up, and Gina, a Hummer.
Also, next to one of the notebooks found in a desk drawer was a business card, Shawna Forde, Minuteman American Defense.
SHAWNA FORDE LETTERS FROM JAIL
Some of the more damning evidence Navarro presented were letter written by Shawna Forde from the Pima County Jail instructing her son Devon Eddy to identify items of jewelry that Gonzalez reported stolen and found in her possession as jewelry he had given to her or that he recognized them from years ago.
According to Kim Smith of the Arizona Daily Star, Navarro also testified authorities also found a letter addressed to a Thomas Gibler. In that letter, Forde asked Gibler to testify he had given her an ornate belt buckle with the letter “G” on it because she loved the “Guess” brand name. She asked him to tell jurors he didn’t remember which Western store he’d purchased it from.
Forde started out that letter, “So the story is this:”
Gonzalez testified last week she bought the buckle when she was a teenager and the “G” was for her name.
TEXT MESSAGES AFTER THE CRIME:
Detective Navarro also presented the jury with transcripts of text messages sent from the cell phones of all the players, including Forde’s daughter Jazmine Eddy. While it is impossible to conclusively put the phones in the hands of the players, common sense tells you who sent the messages and who had possession of their own phones. (text messages)
Navarro also said phone records revealed Forde’s phone made a call to prosecution witness Oin Oakstar on May 30, at 12:28 p.m. The call lasted 2 minutes. The prosecution will rest this morning when court opens, probably after discussing several pending motions with the Judge and then the circus will begin.
Defense Attorney Eric Larsen and Co-Counsel Jill Thorpe will attempt to plant reasonable doubt in the mind of the juries as to Forde’s guilt. Larsen has an almost impossible job ahead of him.
We predict the defense will rest sometime next week, perhaps as early as Wednesday and the case could go to the jury as soon as a week from today.

Day 4 - Shawna Forde Murder Trial

Guest Voz - Porter Corn - Immigration Clearinghouse:
Oin Oakstar was the sole witness to take the stand on Day 4 of Minuteman Shawna Forde’s capital murder trial.
According to Oakstar, who was supposed to be participate in the murders, but was to drunk to do so, it was all business according to something called the “Arivaca Rules”. Either Raul Flores was going to kill him and Albert Gaxiola or they were going to kill Flores, because he and Gaxiola has stolen hundreds of pounds of marijuana from Flore.

They figured they should kill him before he killed them in retaliation. But Oakstar insisted they never discussed a plan involving Flores’ wife and children.
According to David Ricker who is observing the trial: But, they soon began to consider other alternatives. “Once we had gone that far either he was going to kill us or we were going to kill him,” Oakstar testified. “Albert thought we should kill him. We discussed having it done by somebody else. We also discussed doing it ourselves.” There was no discussion of harming the remainder the of the Flores family. “There was no reason to involve his family,” Oakstar testified. “This was business.” Oakstar testified that Gaxiola had met Forde in May 2009. “He suggested inviting her down to help us with our problem,” he said.
And from Kim Smith of the Arizona Daily Star: After he hooked up with Gaxiola, the two decided to kill Flores and other rival drug smugglers, Oakstar said. They decided the best way to kill Flores was to ambush and shoot him from a distance, but rather than “jump in with both feet” they mulled it over for a few months, Oakstar said. When Gaxiola introduced him to Forde in early May, the plan was accelerated, Oakstar said. Forde told him she wanted to rob and kill drug smugglers to fund her Minutemen project, Oakstar testified.
Oakstar also connected the teal van seen cruising past the Flores residence with Forde. The same van was found on Gaxiolas property after the murder with blood stains which were matched to the shooter Jason Bush. Oakstar admitted his testimony was part of a plea agreement which prevented him from going to prison for up to 15 years on weapons charges. However, Oakstar admitted to defense attorney Eric Larsen he was afraid of being charged as an accomplice in the slayings, he had lots of incentives to cut a deal, and all he could think about was getting out of jail.
The trial continues next week. But it appears, a conviction is inevitable.

Why Isn't the Brisenia Flores Murder Trial on the National News? Minuteman Leader Shawna Forde is on Trial! Why No Coverage?

It is appalling. The trial of Shawna Forde, head of the ANTI Immigration Reformist Minuteman Group is underway. She and her 2nd in command, Gunny Bush, are accused of shooting and murdering 9 year old Brisenia Flores and her Dad.
Why isn't this trial on the National News?
There is countless coverage of the Robert Krentz murder. No one knows who shot him. No one has been accused. The local sheriff believes an American killed him. However, some in the ANTI Immigration Reform movement, including the heinous sb1070 sponsor Russell Pearce "assume" the perpetrator just might be an illegal immigrant. There is NOTHING to substantiate this, yet the media covers this possibility religiously.
In the murder case of 9 year old Brisenia Flores, the police know and have charged the murder and currently have her on trial. However, THERE IS NO NATIONAL MEDIA COVERAGE!!! WHY!!! Doesn't 9 year old Brisenia deserve the same coverage as Robert Krentz?
What about the FAKE shooting of Louis Puroll. You remember him don't you? He is the "dirty cop," recently FIRED FOR LYING, who "said" he was shot by some "unknown illeeegal immigrant." However, now that all the news has come out, no one has ever been charged and Puroll has been FIRED for LYING to his boss over this incident.
When will Brisenia receive Justice? 9 year old Brisenia DESERVES Justice! Her murderers need to found GUILTY! Their court case needs to be ON THE FRONT PAGE OF EVERY MEDIA OUTLET IN ARIZONA AND ACROSS THE NATION!
WE NEED JUSTICE FOR 9 YEAR OLD BRISENIA NOW!!!

Day 3 & 3 1/2 - Shawna Forde Murder Trial

Guest Voz - Porter Corn - Immigration Clearinghouse:
Day Three – Shawna Forde Murder Trial – Laine Lawless defies judges order, tries to sneak into courtroom!
The circus is in town apparently today as Roberta Dills aka Laine Lawless blatantly defied Judge John Leonardo’s order banishing all potential witnesses from the trial until after they had testified. That wasn’t enough to stop the border loon from donning a black wig, black trenchcoat and marching into the courtroom as if she owned the place.
Lawless, always one fry shy of a Happy Meal, and who has also blatantly violated Judge Leonardo’s gag order by posting as “Shawna Forde” on the Facebook page she established. She sat behind two detective who immediately recognized her and notified prosecutor Deputy County Attorney Rick Unklesbay who asked the court to stop proceedings. He informed the Judge that “Ms. Lawless is standing here in some sort of disguise.”
According to Dave Ricker, who is covering the trial daily.

Leonardo questioned Lawless as to why she was in apparent violation of his earlier order regarding witnesses. “I am a citizen reporter and have First Amendment rights to be here as any other reporter here,” Lawless said….

Johnson informed Leonardo that she had received an email from Lawless asserting her right to be present in the courtroom during trial. “Despite what she may believe we have not made any decisions as to whether she would be called as a witness,” she said.

Unklesbay told the court that the previous witness had mentioned to him that Lawless had been discussing the case in the hallway outside the courtroom with another individual prior to her summons to the courtroom to testify. He asked Leonardo to order Lawless to not come to the courthouse unless she was summoned to testify in the case. Larsen added that she be ordered from blogging about the case or doing radio interviews as well. “She has had conversations with my client at the jail about daily court events,” he said.
We’ll watch and see what stunt she pulls next and if Judge Leonardo will sanction her as he should.

Other witnesses called included Melanie Aranda, Forde’s younger sister who briefly testified talking with Forde in April 2009. Forde talked to her about robbing people to fund her little Minuteman group.

But, Aranda said, “I didn’t take it seriously, mainly because she has a habit of exaggerating. She likes to talk big”

Chuck Stonex, Shawna Forde New Mexico “director” and the person called to bandage Bush’s bullet wound testified about the event and concluded with telling the prosecutor that he believed Forde was in charge of whatever mission they were on the night Bush got shot.
As usual, we’ll be updating as things happen.

Day 3 1/2 – Shawna Forde Murder Trial – Witness ties Forde to shooter Jason Bush
Minuteman Shawna Forde’s “New Mexico Director of M.A.D.”, Chuck Stonex, took the stand yesterday and under oath, ties accused Minuteman child killer Shawna Forde to her number two in the gang, Jason “Gunny” Bush, the suspected triggerman.
‘You should have seen how scary he looked last night with his face all blacked out,” Stonex, told the jurors referring to comments Shawna Forde made directly to him the night he and Laine Lawless were called to a home in Arivaca Arizona to tend to a bullet wound Bush had received.

More on this witnesses testimony can be

Day Two – Shawna Forde Murder Trial – Prosecution has a “surprise” witness – Jason Bush’s girlfriend

Guest Voz - Porter Corn - Immigration Clearinghouse:
Day Two – Shawna Forde Murder Trial – Prosecution has a “surprise” witness – Jason Bush’s girlfriend
Testimony continued to move along today with the defense cross examining the widow of Raul Flores and mother of 9 year old Brisenia Flores in Minuteman Shawna Forde’s capital murder trial. Perhaps the highlight of the day was when prosecutors announced to the Court that their investigators had found Jason Bush’s girlfriend, Melinda Shelton and were going to have her testify. The stunned defense attorney Eric Larsen immediately objected saying they needed time to interview her and investigate her story. (another defense ploy to delay the trial) Prosecutor Rick Unklesbay replied Larsen shouldn’t be surprised because Shelton has always been listed on the witness list and had in fact, been scheduled to testify today.

Judge John Leonardo declined to allow prosecutors to present her as a witness until tomorrow, giving Larsen and Jill Thorpe the opportunity to interview her this evening. It is being reported that Shelton will testify that Shawna Forde at her house in Meadview Arizona in late May (the murders occurred on May 30) and the next time she saw Bush, he was suffering from the gunshot wound to the leg.

Larsen continued his cross examination of Gina Gonzalez by trying to get her to admit she couldn’t identify Forde as the “mean” woman who was barking orders to Bush and the other home invaders. Vut Gonzalez, a brave woman to say the least, threw it right back at him. Larsen asked her, “As you sit here today you still can’t say Shawna Forde was in your home, right?” Gonzalez answered, “No, because I don’t know Shawna Forde.”

Further along in the testimony, Gonzalez stuck to her guns insisting, “She looks like the person in my house.”
Larsen asked, “You also indicated that she was initially in brown camouflage, correct?” Gonzalez answered, “Yes.” “And the second time she was now in green sort of border patrol,” Larsen asked. Gonzalez said, “Yes, like she had taken her jacket off.”

Gonzalez testimony also put the teal mini van found on Albert Gaxiolas property which had Bush’s blood and DNA in it and that had been seen cruising the Flores neighborhood earlier in the day.

Albert Gaxiola’s next door neighbor was also called to testify and she placed Shawna Fordes orange Honda Element at Gaxiolas house 4 hours after the murders. Earlier she testified, about 01:15 Gaxiola was out in his yard trying to start a flooded car. This was half an hour after Gonzalez 911 call. The witness also put Forde and another man at a gathering in Gaxiolas back yard about a week before the murders.

Testimony continues tomorrow as David Winston a medical examiner continues his testimony the autopsy and jurors get a first look at the victims.

Day One – Shawna Forde Murder Trial – Gina Gonzalez Testimony

Guest Voz - Porter Corn - Immigration Clearinghouse:
Day one in the capital murder trial of Minuteman Shawna Forde began mundanely enough with a conference in Judge John Leonardo’s chamber with the attorney’s on both sides and media representatives present. One of Judge Leonardo’s first ruling in the case in principal was to issue a gag order prohibiting any witnesses that might potentially be called to talk about the case to anyone including radio stations, blogs, email or person to person, television, etc. Not surprisingly, one of the potential witnesses has already seen fit to ignore the Judges order.

Opening statements were the first order of business. For the Prosecution, prosecutor Kellie L. Johnson told the jury ”Not only will the state prove to you that Shawna Forde was in that house that night, barking orders and telling people what to do, the state will prove that Shawna Forde organized and planned this offense.” With apparent difficulty, Johnson went on to describe the crime and Brisenias last moments.

Up next, defense attorney Eric Larsen told the jurors the state’s case is essentially a donut, with circumstantial evidence all around, but nothing to put Shawna Forde in the middle. He went on to say his client, Shawna Forde is a “big mouth” and an ”exaggerator extraordinaire” for boasting of her plans to rob drug smugglers. Nothing more than a woman who wants to be more than she is, but she wasn’t in the house that morning.

Gina Marie Gonzalez, widow and mother of the murder victims disputes that.

The highlight of the day was the testimony of Gina Gonzalez and we got a glimpse of what transpired on the morning of May 30, 2009.

Gonzalez testified that as she lay on the floor pretending to be dead, in hopes that the shooter would ignore her and leave, listening to her husband dying, the shooter, who evidence will identify as Jason “Gunny” Bush, interrogated 9 year old Brisenia Flores about the whereabouts of her sister. Brisenia told Bush her sister was with her grandmother and Bush demanded to know where she lived. Earlier, Bush had said to Raul, ”Don’t take this personal, but this bullet has your name on it,”

“She was really scared. Her voice was shaking. I know she’s crying and really scared,” Gonzalez cried.
Bush, out of bullet after shooting Raul and Gina, stood there calmly reloading his weapon as Brisenia demanded to know why he had shot her father and why he had shot her mother.Ignoring Brisenias pleas, Bush put the gun to the childs face and pulled the trigger. Gonzalez testified she heard the shot and saw her daughters body go flying across the room. That was followed by a second shot which blew out the back of the child’s head.

Gonzalez testified that the woman in the house looked like Forde, but she said she couldn’t definitively say it was her “because I don’t know her personally.” She failed to identify Forde in a police lineup after the shooting. Some have considered that Forde might have been wearing a brown wig when she entered the house the first time, which would explain Gonzalez confusion in the identifying Forde completely.

More tomorrow as things develop.

Guest Voz IC: Opening Statements Tuesday in Minuteman Shawna Forde Murder Trial

Guest Voz - Immigration Clearinghouse: Opening Statements Tuesday in Minuteman Shawna Forde murder trial
Opening statements in the capital murder trial of accused Minuteman child killer Shawna Forde, will begin Tuesday, January 25, after attorneys on both sides concluded their voir dire of the pool of 98 potential jurors this afternoon and jury instructions were given .

It began on the morning of May 30, 2009, Raul Flores heard a knock at the door of his Arivaca, Arizona, home. When he opened it, he found a man and a woman claiming to be law-enforcement officers in search of fugitives. Minutes later, the man shot Flores six times, in the head, chest and arm. He died at the scene Then he pumped three bullets into Flores’ wife, Gina Gonzalez, hitting her in the arm, leg and chest. She survived but played dead.

“Why did you shoot my mom?” Gonzalez’s 9-year-old daughter, Brisenia Flores, asked the gunman. Those were her last words. The man put a gun to her head, fired off two rounds, one through the cheek and the other other that blew out the back of her head.

Senseless murder conceived and acted on by Shawna Forde, a notorious nativist who was so zealous in her quest to control the border she came up with a plan to fund her organization; stealing from people she thought were connected with drug cartels.

More than 60 witnesses are expected to take the stand during the trial. According to Kim Smith of the Arizona Daily Star:
•Gonzalez – She will testify that although she was unable to identify Forde as the woman home invader in the days after the slayings, she now believes Forde looks “exactly like her.”
•Oin Oakstar – The ex-con will testify he and Gaxiola wanted to get rid of Flores, a competitor in the drug trade. Oakstar claims the plan was for Bush to shoot Flores outside his home, and nothing was said about a home invasion or harming Flores’ family. Oakstar said he got too drunk to go the night of the slayings. He will also testify he had damaging conversations with the suspects after the shooting.
•Robert “Anglo” Copley and Ronald “Raven” Wedow – The two Colorado men say Forde recruited them to take part in a home invasion in which a second team would gather up drugs, money and weapons, which would be sold to help the Minutemen American Defense.
Copley and Wedow are the two Colorado Minutemen whom Forde approached with her home invasions plans and who later reported the encounter to the FBI.

The state will also present physical evidence that ties Forde to the murders.
According to court documents, prosecutors have damning texts sent between cell phones registered to Forde and Gaxiola, texts that were sent the morning of the slayings. In addition, detectives found jewelry belonging to Gonzalez in Forde’s purse and women’s camouflage clothing in Gaxiola’s house.
If convicted, Prosecutors Rick Unklesbay and Kellie Johnson will go for the death penalty.

Guest Voz - Immigration Clearinghouse: Brisenia Flores' Murderer Goes to Trial!

Guest Voz - Immigration Clearinghouse: Brisenia Flores' Murderer's Trial begins with questionnaire for prospective jurors
The circus that will be the trial for accused Minuteman child killer Shawna Forde began this morning, barely noticed by the media, as 225 prospective jurors showed up at the Pima County Courthouse in Tucson Arizona.
The prospective jurors were given an 18 page questionnaire to fill out for the attorneys. Those who aren’t immediately dismissed, based on their answers, will return to court on January 11 to answer further questions face to face.

According to Kim Smith of the Arizona Daily Star:
Among other things, the jurors were asked if they know the facts of the case, would they be able to ignore media reports when making a decision and how they would describe their political views. They were also asked if they have any opinions regarding private organizations monitoring or defending the border, if they’ve heard of Forde’s group Minutemen American Defense (MAD) and if they have any strong opinions on illegal immigration. How people answer the questions will be key as prosecutors contend Forde thought Flores was a drug dealer and recruited a group to raid his house for drugs, cash and guns to help MAD. Jurors were also asked their views on the death penalty since prosecutors will seek to have Forde executed if she’s convicted.

MOTIONS DENIED OR DELAYED
On Tuesday, presiding Judge John Leonardo denied a defense motion for a postponement in the case. The attorneys on both sides of the case also argued motions based on the assumption that Forde will be convicted.
Again, according to Kim Smith of the Arizona Daily Star:
When someone is convicted of murder in a capital case, attorneys present what are called aggravating and mitigating factors. The aggravating factors, as one might guess, are those things that might make someone more inclined to vote for the death penalty. Mitigating factors are those that might cast the defendant in a more favorable light — dysfunctional childhood, low IQ, substance abuse issues, etc.

Late last month, defense attorneys told prosecutors they want jurors to hear that Forde was sexually abused as a child, raped in December 2008 and shot in January 2009 and all of these things led her to suffer from PTSD. Prosecutors responded by saying they want jurors to know there is no evidence of any of that. Forde is the main source for the childhood abuse and police closed the rape and shooting cases, saying there was insufficient evidence.

The basis for the motion for the continuance by the defense was to give them more time to investigate Forde's involvement in the shooting of her ex-husband in Everett and the subsequent false rape and shooting charges she made to get police to back away from her as a “person of interest” in her husbands shooting. It is alleged that Forde was also involved in a couple of crimes in California after the home invasion murders in Arivaca. Our sources tell us a detective from northern California who investigated these crimes may be called to testify.
Also on Tuesday, Gina Gonzalez, who miraculously survived the ordeal and was involved in a shootout with gunman Jason Bush, briefly testified in court for the first time. Gonzalez testified Tuesday she recognized Forde for several reasons. It was the first time she’d seen her in person since the incident, she wasn’t wearing makeup (the women in the photo lineup were wearing makeup), she had the same smile and her hair was styled the same way.

As for the smile, Gonzalez said that after the shootings, the home invaders ransacked her house and then left. However, when she was on the phone with 911, she looked up and saw the woman standing on the threshold, smiling. “She saw me standing there and her face dropped and she said ‘Oh, SHIT!,” Gonzalez said.

The woman went back outside and a few seconds later Gonzalez said she and the tall man exchanged shots. (Prosecutors think the tall guy was Jason Bush.) Gonzalez never came out and said “Shawna Forde was the woman home invader.” She did say: “I can say she looked exactly like the person who was in the house that day” and “I can’t say Shawna Forde was there because I don’t know Shawna Forde.”

Judge Leonardo will rule on what can and cannot be admitted into evidence in the coming weeks. It appears the defense strategy is to try and get all incriminating evidence against Forde thrown out and show her to be a “patriotic” but “misunderstood” individual who was dealt a raw deal in life, although no evidence exists of that other than Fordes own words.

Brisenia Flores' Murderer, Minuteman Leader Shawna Forde, Attempts to Exclude Key Evidence

AZ Daily Star reports: Murder suspect Shawna Forde's attorneys have filed more motions to keep evidence away from the jury. Just a quick recap first. Forde, Jason Bush and Albert Gaxiola are charged with first-degree murder in the deaths of Raul Flores and Brisenia Flores, who died during a home invasion in Arivaca in June 2009. Raul's wife, Gina, suffered a non-life threatening gunshot wound herself, but prosecutors say she managed to shoot Bush before he fled.

One of the state's key witnesses is Oin Oakstar, who is expected to testify the trio wanted to steal Flores' drugs, money and guns and Gaxiola wanted to eliminate him as a competitor in the drug trade. All three defendants have entered pleas of "not guilty" and Forde and Gaxiola's attorneys say they weren't even at the scene that night.

One of Forde's defense attorneys, Jill Thorpe, filed a motion recently asking Judge John Leonardo to prevent prosecutors from telling jurors:

. that Oakstar claims he saw Bush after the home invasion and...
1) Bush told him that the plan "went to (expletive)"
2) Gina Flores had shot him.
3) Gaxiola and Forde both asked him to bring painkillers for Bush because of the gunshot wound.

Thorpe argues all of the comments are inadmissable hearsay.

Forde's other attorney, Eric Larsen, filed a separate motion asking Judge Leonardo to keep out a bunch of stuff Forde's family members have told investigators. For example, Larsen doesn't want jurors to know Forde's mom has described Forde as a "sociopath" or that Forde's mom and brother think she's behind the December 2008 shooting of her former husband. In addition, Larsen doesn't think jurors should be privvy to the fact Forde's brother claims he saw her taking his painkillers once.

Lastly, Larsen doesn't want Forde's brother, mother or sister to be allowed to discuss Forde's views on minorities. According to Larsen, mom doesn't think Forde is a racist, her brother thinks she is and her sister "says Forde is racist in her comments but would socialize with minorities."

All of this stuff would unfairly prejudice the jury against Forde, Larsen wrote. Prosecutors haven't responded to either motion yet. Forde and Gaxiola are currently scheduled to go to trial in January, although the defense attorneys hope to convince Judge Leonardo to split the cases into two separate trials. Bush is scheduled to go to trial in March. If convicted, the trio could get the death penalty.

Update: Minutemen Shawna Forde & Gunny Bush Murder Trial Update (for murders of 9 year old Brisenia Flores & her Dad)

Guest Voz: (my friend) Porter Corn - Immigration Clearinghouse
Possible defense strategies revealed for Minuteman Shawna Forde’s Trial
Before Forde defense attorney Eric Larsen left on vacation, he filed some documents in Pima County Superior Court outlining his defense strategy in the upcoming trial of Minuteman Shawna Forde, accused mastermind in the murder of 9 year old Brisenia Flores and her father Raul. This move was required under the Arizona Rules of Criminal Procedure.

The prosecutions theory is that Forde needed money for her little border vigilante group, MINUTEMAN AMERICAN DEFENSE, so she enlisted the aid of Jason Bush and Albert Gaxiola to rip off Raul “Jr.” Flores, a purported drug dealer. Forde discussed this with others who are expected to testify for the prosecution, including two Colorado Minutemen and the star of the show, Oin Oakstar, who was supposed to be the fourth person but got too drunk and forgot to show up for the party.

Some of Larsen’s defense strategies were expected, such as “the state failed to prove their case,” but then, there were these others:
•Gaxiola was romantically involved with Flores’ widow
•Forde wasn’t present at the crime scene.
•Forde was misidentified as a suspect.
•Gaxiola and Oakstar conspired to eliminate Flores as their drug trade competitor.
•Flores’ widow named Gaxiola as a perpetrator.
•Gaxiola had been feuding with Flores.
Larsen said he also plans to impeach the expected testimony of Forde’s mother, brother and Oakstar.

In addition, he says the jewelry found in Forde’s possession isn’t Flores’ widow’s, as alleged by prosecutors.
Larsen also filed a document listing the mitigating factors he intends to tell jurors about during the penalty phase of the trial. Some of them include;
•Neuropsychological deficits/damage/frontal lobe deficits.
•Multiple abandonments as child.
•Sexually abusive childhood.
•Dysfunctional childhood.
•Manipulated/gullible
•Volunteer work, public service, lack of felony record, productively employed
•History of non-violence
•Polysubstance abuse
•Medical records, including records from a stroke
So in a nutshell, the defense will be that Gaxiola was screwing Flores wife in order for Gaxiola and Oakstar to ripoff the cuckolded husband of drugs and cash they may or may not have had. And in the course of things, Forde wasn’t present at the crime scene yet she was misidentified as a suspect at the crime scene.

With that kind of logic, we can expect the trial to last less than a week. And where does the shooter Jason Bush fit into all of this? After all, his blood was found in the teal van parked at the Gaxiola residence and seen cruising the hood around the Flores property the morning of the murders with a “blonde woman” in the passenger seat. And let us not forget one of Forde’s staunchest defenders, Laine Lawless, who accompanied Chuck Stonex to the Gaxiola house to patch up Bush’s bullet wound.

And once the jury comes back with a guilty verdict, to keep Forde out of death row, the “mitigating factors” to Fordes actions has me falling off of my seat laughing my axx off.

So to wrap up the defenses that will be used to keep her off the gurney, the defense will accurately portray Forde as a crazy bxtch who wasn’t born with the proverbial silver spoon in her mouth, who had challenges in her childhood that others have. A crack head who couldn’t decide on any one drug of choice so she tried many as she plowed her way through life conning people and being conned herself. Selling her axx to undercover officers on the streets of Tacoma at age 14 might be considered a sexually abused childhood by some, but not by others. And she was productively employed hunting Mexicans on the border so her life should be spared for the heinous and calculated crime which took the life of an innocent 9 year old child because she has a history of non-violence. Did I get all that right?

I rest my case. Thank you Kim
