Official Language: Penalty - Learn English or GO TO JAIL! (Includes Legal Citizens!)

For all of you who promote "Official English" and who said this would never happen, here it is. A Judge has ruled "Learn English or Go To Jail!" The judge imposed this sentence on those here legally. As we move closer to a "Gestapo State," even with no standards set, the judge says, “There’s no way young kids can be hurt by knowing how to read and write the English language.”

That’s the succinct directive Luzerne County Judge Peter Paul Olszewski Jr. made as part of his sentence to four criminals on Tuesday. The defendants – Luis Reyes, Ricardo Dominguez, Kelvin Reyes-Rosario and Rafael Guzman-Mateo – all needed translators when they appeared in court to plead guilty to criminal conspiracy to commit robbery. It led to Olszewski leveling the unusual condition. He sentenced them each to four to 24 months in the county prison, but paroled three of them because they have already served at least four months. But in order for them to avoid the 24 months in prison, Olszewski ordered the men to learn to read and write the English language, earn their GED, and, within 30 days of release, get a full-time job while on parole. The defendants, who range in age from 17 to 22, are to return to court in one year with their parole officers to take an English test, according to Olszewski’s order. “If they don’t pass (the test), they’re going in for the 24 (months),” Olszewski said.
The ruling, the judge said, is supposed to help, not punish. “There’s no way young kids can be hurt by knowing how to read and write the English language,” he said. “It’s a means to helping them get a better education, getting a better job. Period.” Whether the legality of the ruling will be challenged has yet to be determined.
Attorneys Joseph Yeager and Ferris Webby, who represent the suspects, are looking at the ruling and laws before deciding whether to appeal. Neither has seen such an order in any past cases, they said. “First of all, let’s say it’s unusual,” Webby said. Webby said his role as an attorney requires him to look at the legality of the ruling, but, as a person, he knows Olszewski’s choice is good for his client, Guzman-Mateo. Guzman-Mateo realizes it, too.
“My client is happy,” Webby said. “I think it’s going to help him. It’s going to help him succeed.”
But that doesn’t make it right, said Agapito Lopez, a Latino community leader from Hazleton. He said he believes the ruling is a violation of the suspects’ rights. I think that it’s contrary to the Constitution,” said Lopez, who stressed he is not an attorney and is speaking from a lay person’s perspective. “I don’t think that is due process. … I think this can be challenged in court.” Lopez said he will speak with attorneys from the American Civil Liberties Union to see if the decision should be challenged.
Police said the four were part of a group of people that approached two men, Reese Tankalavage and Cletus Mumie, on May 29 on Locust Street and asked them if they had any marijuana. When Tankalavage and Mumie said no, the four suspects told them to empty their pockets. That’s when one of the people in the group struck Mumie in the head with a rawhide bone. Another man pulled out a gun. The group then searched the duo’s pockets before telling them it was “their block and they better not see them around there anymore,” police said.
In sentencing the four defendants on Tuesday, Olszewski gave Reyes, Dominguez and Guzman-Mateo immediate parole. Reyes-Rosario is doing jail time on an unrelated drug charge. His sentence in the robbery case will begin after he completes the drug sentence. Olszewski said the language condition he imposed on the defendants, who are resident aliens, was not something he had planned. Once he saw all the translators in court for one case, the idea dawned on him.
The decision, he said, could help cut down on extreme costs associated with the paying for translators for each court appearance. Plus, he said, one of the defendants only went to third grade; the others didn’t finish high school. Learning English will help them get their GED first, and then a job, he said. “Do you think we are going to supply you with a translator all of your life?” he asked them.
Olszewski is ready to face any flak from the ruling. “I’d like anyone to tell me that learning the English language is not a good thing,” he said. “I’d love to hear from them.” Learning the language could help the suspects, Lopez said. But it would not assure them of getting a job – that theory is merely mythical, he said.
“This is a country in which English is not the official language,” he said. “We cannot force people to learn the language.” Olszewski said the parties can ask him to reconsider the ruling within 10 days. No one, he said, objected to the ruling in court Tuesday. Olszewski is unaware of whether this condition had been previously imposed. It’s not the first creative sentence Olszewski has imposed. He regularly orders defendants to get and maintain a full-time job, but also helps them find work. He has his tipstaff, Ron Zukosky, coordinate with an employment agency to find the defendants work. The judge also has ordered young defendants who dropped out of school to return and finish school. “There’s no way young kids can be hurt by knowing how to read and write the English language.” Judge Peter Paul Olszewski Jr.

Oh, you are really stretching the truth on this one, dee. The judge was giving the criminals a way to avoid a prison sentence for their crimes by learning English and getting a job. What is wrong with that? Would have serving a 24 month sentence in prison been better? What the H is wrong with you? The judge wasn't implying that they could no longer speak their native language in this country. You find something wrong in immigrants assimilating in our country and learning our language? You really stooped to a new low on this one, dee. Why don't you move to a Hispanic country, you don't belong here with your attitude about this country.

Wrong Pat! They are in Hazelton, PA, the home of one of the 1st restrictionist laws by their restrictionist Mayor.
The judge is sending a message on the ANTI "Rule of Law" and Official English legislation.
What is wrong is, this is forcing legal residents to pass a test or be thrown in jail for 2 years for a crime that would have otherwised been been provided a hand slap as penalty. This is a violation of civil liberties all in the pursuit of Official English Laws!

Please re read the article.
1. The boys charged are NOT illegal.
2. These teenagers would have only gotten probation. They went up to other teenagers and asked if they had pot. I looked up the other boys myspace and they have a picture of marijuana as their background picture. Then when the boys got into a shoving match, one boy hit another with a hambone. There were no charges of assault with a weapon.

3. The issue is the Judge is from Hazelton, well known for their Anti Immigrant stance. He is trying to push for Official English. We all know it takes a generation to assimilate. This restrictionist judge is just trying to make these young boys learn quicker or throw them in jail. Period!

If it takes a generation to assimilate and learn English as you say it does, I am now wondering how it is that the teenagers who you state are here legally do not know English? If they were born here, how is it that they do not speak English? If they were not born here and are here with their passports, on a vacation, I understand why they don't speak English. You are the one that states it takes a generation to assilimilate. Just wondering where these boys fit in.

Alternative sentencing is meant to keep people out of jail who would benefit from the alternative sentence.

I hardly think what the judge did is illegal.

And, a resident alien can be deported for committing a felony in this country.

What is clear is the judge (former prosecutor and supporter of the Mayor) is trying to make a point. He is trying to push Official English. This is what is troubling. The Official English groups continue to say their view is not to establish Criminal penalities for citizens or anyone else. Yet, here you have this judge imposing criminal penalties (2 yrs in Prison) if these young boys cannot pass an official English Test in a year.

Up to this point, and even from the defendant and his attorney, Guzman Mateo is happy.

This Lopez guy really needs to keep his nose out of the business of the defendants. A Latino community leader, that can not see past his skin color. A chance to succeed in life from the judge, yet the Latino Community leader wishes to keep these defendants suppressed. Reminds me of the National Hispanic Caucus keeping the passage for extension of H-2B visas from allowing in up to 120,000+ vs. the 66,000 yearly. I say THANK YOU Hispanic Caucus and Latino Community leaders for keeping your people oppressed.

dee, you are the one not reading the article. Their choice was learning English and getting a job vs 24 months in prison. Duh, what a hard choice. Is asking a "legal" resident or citizen to learn English a punishment of some kind?

It doesn't matter whether this incident happened in Hazelton or Los Angeles. Again, what is wrong with Official English. Most countries have an official language. God, your family has been here for generations and yet you deny and defy your own country's national language. Like I said you should move to a Hispanic country then. You don't belong here. YOu are only an American on paper.

How is making English our official langauge violating civil liberties? An official English bill does not deny anyone the right to speak another language in this country and you know it!

I thought about this overnight.

First of all, only 1 of them is a boy at 17, the rest are men. I know the judge called them boys and young kids, but in fact they are grown adults. One of them pulled a gun during their attempted robbery.I'd bet there was no permit that went along with that gun. And, one of them is already in prison on a drug charge he apparently committed after this crime. Speaking about "their" block, I'd bet they're in a gang.

If somebody pulled a gun on me and struck me even with their hand looking for money, I'd be looking for way more than 4 months in jail. But, the judge, instead, looks at these thugs as "young kids" who have no education, no jobs and no future. He treats them like jr. high children who are truants, hoping they'll "grow up" and become responsible adults. He's way more compassionate than I would be.

I'll make a prediction here. Unless they get some kind of education, learn to speak english and get jobs, they're all going to end up committing bigger crimes, probably end up seriously injuring or killing someone or end up dead themselves on the streets.

As you said, these boys already served their time and they would be on probation. Period. Now they have conditional. Their condition is not only to learn English, but they have to PASS the TEST.

If you think this is so good, why not impose this same LAW on every boy and girl in the USA. Why not pass a LAW that says Pass the Test or Go to Prison. Get a job or Go to Prison. Go on Birth Control or Go to Prison.

You would say this is better for them. We should Thank the Judge.

Lets go a step further. Go to all the Street People, go back and get a job or Go to Prison. To every kid that goes to a Rave, stop going or Go to Prison.

These kids have not been here a generation. They may have just arrived. They are Resident Aliens.

We all agree it takes a GENERATION to fully assimilate. Now The Judge is making them Pass the Test in a Year OR these Boys GO TO PRISON for 2 YEARS!

The Latino community leader is putting his nose where it does not belong, and if the attorney for Guzman-Mateo finds that the punishment is wrong then he can take it up with the courts, NOT THE LATINO COMMUNITY LEADER!!

Why are you so set that this is a civil liberties issue, when the "boys" are taking the deal happily? Are you wanting to suppress them along with the Latino Community Leader and the National Hispanic Congress? Why not give them the opportunity to better themselves?

Back to the English requirement, I agree, the judge should have just let them cool their jets in jail for 2 years. They're lucky they weren't charged with a worse offense or deported. These are just the type of people we want as citizens in this country, working hard, doing the jobs Amerians won't do.

Of course the court appointed Anglo lawyer doesn´t give a rip that these boys´ civil liberties are being violated. Come next year IF they don´t pass the mandated test and they end up in prison, what will he say then? He won´t care.
This penalty is weighing over their heads for the next year. Would you be proficient enough to pass a test in another language if you had a year? And had to work and had to change your lifestyle? And had no money? Hard to tell. Odds are, these young boys who served their time will be in Adult Prison next year at this times serving the future 24 months in Adult Prison. Don´t drop the Soap!

"Paroled" is the key word here, none were let out due to having served their time.

Comprehend Dee, it saves time of explaining to you the actual FACTS.

Mateo could have, as well as the others, denied to forgo the "unusual sentence" however, "THEY CHOSE" to except the terms. Odds are these "boys" were already in adult prison (County or City jail) for the 4 months they served.

Lets see.... they had freedom of choice, due process, a fair trial, and the freedom of speech, yet they chose to accept the judges "unusual sentence". Seems all of their civil rights were granted.

Would you have been happier if they were jailed for the full 24 months as their sentencing required?

A parole officer asked Catholic Social Services, where Arias works, about tutoring and was told all the programs have a long waiting list.
“We would be glad to do this. We need the resources, and we need the funds,” she said.

There are other ESL classes around, that is just one, free at that. I'm sure if he/they looked hard enough, one could be found, either for free, or they themselves could pay for the class as well.

The article is no different then the one you posted, with the exception of a little more info.

"These boys are legal resident aliens. They are new to this country." So what!!!! All the more reason for them to stay out of trouble. Be thankful they didn't get turned over to ICE for deportation due to their crime.

A generation to assimilate? B.S. My grandma learned the language and assimilated just fine in her first generation in this country. Course that was in 1900 when there were ESL language programs all over the place and they had tons of money, etc. haha. Please do not even try to tell me it's not possible because I had living proof that it is.

dee, they would have gone to prison anyway. They were getting a break by being given the option to learn English rather than going to prison. They were given a choice and they chose the latter. Why are you critizing someone for a decision they made on their own? Learning English isn't punishment. It will help them assimilate into our society and be productive. You get off on some wild ethnocentric melodramas all the time. You act like this is some Latin American country rather than the USA.

You are missing two things Pat.

1. How many US Citizens would fail the test? I use the internet every day and I see constant spelling and grammar errors. Are you holding these boys to a higher standard than anyone else and sending them to jail?

2. Hazelton is a nativist town. Their Mayor established restrictionist laws all to advance his own political career and in pursuit of getting elected to Congress. Now his friend, the Judge, is supporting Official English and imposing these sanctions to these young boys. Learn English, Pass the Test or Go to Jail!

For those that don´t know, DailyKos is a raving Obama site. As I have shared, I am a staunch Democrat and will vote for Hillary or Obama in November, but tend to lean towards Hillary. At the DailyKos, they hate everything Hillary and McCain. Today, I decided to go poke fun at them due to a comment I heard today on MSNBC bashing poor Chelsea.

Dee i don't know the last time you checked in with Arizona, but the deportation of the undocumented has worked well there - hospital emergency rooms are less crowded -

also, many of the undocumented had children born in the usa - since these children are us citizens they were eligible for welfare and many of the undocumented collected welfare (on behalf of their us citizen children) the point is the exodus of the undocumented from arizona means that arizona has been able to stop making those welfare payments

so it has been a success for taxpayers, just as intended.

as a bonus, some of the scummy employers who chose to flout the law by hiring the undocumented have exited the state as well

Pat, Several states do have Official English laws, ex CA. However, they do not enforce their "printing of non-govt info" portions.
There are two issues I am addressing:
1. In this post, I am focusing on the fact that several ANTIs say once Official English Bills are passed there will be no criminal penalities. This penalty is an EXAMPLE of what could happen once these types of laws pass.

2. The current bill in Congress and those in several states restrict the printing of Govt materials in any language except English. The big push for this NOW is so that in Nov, no voting materials will be printed in Spanish (in particular) or assistance provided to Spanish speaking voters. That is the ANTIs point in promoting this bill. I will be writing more about this in my next post.

One has to be able to speak English to become a citizen of this country and only citizens can vote. Those who don't comprehend English enough can bring a translator with them when they vote.

We need to cut our taxes in every way possible and it will save us billions in not printing any government documents in anything other than English.

Your interpreter lied, give me a break. It is an excuse. If you don't like what the judge is having you do for parole, then go back and sit in jail for the remainder of your 2 years. As far as I am concerned, your armed robbery and assault should get you kicked out of the country and barred for life. We don't need you criminals here, nor do we need to import them from other countries. This is all the more reason for you to learn English and the USA's LAWS before your 1 year is up. You took the deal, live up to it or leave. Hell, at 17 I was in the military, no reason why you can't work full time in the evenings and finish school during the day.

3 men ordered by judge to learn English deported

"The three men ordered to learn English by Luzerne County Judge Peter Paul Olszewski two weeks ago have now been ordered out of the country.
Rafael Guzman-Mateo, Ricardo Dominguez and Luis Reyes are from the Dominican Republic, but are resident aliens who are being deported because of their criminal convictions.

The four jumped two men on Locust Street alongside Vine Street Cemetery on May 29, 2007, and pulled a gun. One of the victims was hit with a rawhide dog bone, police said.
Police have identified all four as members of a street gang."

Brush up your English, Dee. You refer several times to the convicted criminals as "suspects." Not. They are guilty; and your and anyone else's hand wringing over the Constitutionality of the sentence betrays the ingratitude of the militant immigrant class we're battling today, as well as profound blindness to sheer grace. The judge was looking out for their sorry asses -- and you complain!

You can speak whatever language you want at home but there is NO REASON that my tax dollars shoul dhave to pay for a translator! Our laws are written in english, street signs are in english, the writing on our currency in english and the bill of rights that gave these scumbags a right to a trial in the first place is written in english. Citizenship comes at a price, one of the prices we must pay is understanding english so we can be functional in society. Speak whatever language you want at home.

My mother-in-law moved to this country almost 60 years ago from Germany...she was six years old. When she moved here there were no signs in German, there were no school books in German, there were no concessions, no excuses...she had to learn English, and not only her, but her parents as well. If they hadn't learned English she never would have graduated from school, got a driver's license, etc. I have no sympathies for anyone who chooses to live in this country and yet refuses to learn to read and write English, and I don't care if you are Mexican, Chinese, or Egyptian. If you want to live here, then learn to read and write English...that is the only way you will succeed in our culture. If people had a clear understanding of the language I am sure that we would not have the rampant rate of crimes that we do. Crime rates greatly increase in areas with poor education, so I guess I am aiming this post at not only those who don't know the language (immigrants) but also those who are American, yet have an education that doesn't go past the elementary level. When was the last time you heard a doctor speak "ghetto" or a lawyer speak "redneck"??? And stop blaming the "system". As human beings we all have the ability to think for ourselves. If you can't find what you need to succeed, then go somewhere else to find it. Pursue an education...look around, the resources are there. I know what I am talking about...I grew up on welfare after my parents were divorced. I did my time standing in food lines waiting for a handout. I was educated in the public school system...yet I refused (absolutely refused) to live my life like that...I now own my own business and I am succeeding in the profession I have chosen. My children go to a private school and in all sense of the word I am successful. I am saying, it can be done. Do something positive with your life, get an education and become a positive member of the community. That doesn't mean that you can't speak the language of your birth in the company of your kin or friends, but outside the walls of your home you should speak the English, and to all the lawmakers...concessions should not be made for languages (other than English) to be wrote or spoke in schools, D.M.V.'s, street signs, etc. If people can't read a stop sign then they don't need to be driving a car. If they can't do basic reading, writing and math, then they don't need to be graduating. People who can't read and write English should not be allowed to buy firearms. People who refuse to learn the language only hurt themselves and limit what they can do because employers don't hire people who can't speak English. People who can't speak English usually get saddled with jobs that pay below minimum wage (farm work, etc). If they choose to not succeed then why be here....?

An official language is SO WRONG. If anyone thinks it is a good idea, try living in France or Germany. Horrible places if your native language is different. Children face discrimination in school. Everyone is FORCED to learn this Franco or Germanic nonsense. Why is it NONSENSE ? Because you are FORCED to learn it, because it is OFFICIAL. IF you love FREEDOM and DEMOCRACY and TOLERANCE then you HATE the idea of an official language. GOD BLESS AMERICA AND ALL COUNTRIES WITH NO OFFICIAL LANGUAGE since this means everyone is welcome to speak their native language and is RESPECTED.
BOYCOTT countries with an official language. DEFEND FREEDOM !
