Kick in the Head Case Update: Piekarksky´s Friends are saying Judge May Dismiss the Case!

A Mockery of Justice is about to occur! The murderers who kicked Luis Ramirez in the head and murdered him may soon be set free. I ask all PRO Bloggers and PRO supporters to be alerted to this case and to contact all fellow PRO Bloggers and supporters! This case is similar to the New York Race Crime murder! The Sheriff´s Dept did not want to bring these murderers to justice and now the judge is considering dismissing the charges!! Their friends are laughing at the possibility! This miscarriage of justice CANNOT occur! These Murderers MUST BE BROUGHT TO JUSTICE, otherwise we are doomed to see more Latino Hate Crime murders occur! Alert your friends! Alert the Justice System! DO NOT Allow these Murderers to be Set Free with No Penalty!! If these murderers are allowed to go free, NO Latino is SAFE from these Types of HATE CRIMES!!

Shenandoah Teens Dismissal Hearing

The three teenagers charged as adults in Shenandoah, Derrick Donchak, Colin Walsh, and Brandon Piekarsky, asked to have the charges dismissed. A hearing was scheduled for 9:30am this morning (11/13/08). Two friends drove an hour to my house, where another friend and I waited. The four of us drove another hour to Pottsville to witness the goings-on of this dismissal hearing. When we first arrived, I recognized some of the wonderful people I’ve met and have been keeping in touch with. I am happy to say the families are remaining strong and supportive! I overheard someone talking about a plea bargain. As I listened, I learned that only yesterday, the District Attorney offered a sweet deal to the boys. Apparently, he was willing to drop everything but assault and ethnic intimidation, with a sentence of ten months in county prison. Wow. I guess even the DA knows he has NO CASE against these boys, but since he’s up for election as a judge, he needs SOME kind of conviction on them.
We entered the courtroom, and waited and waited. Then we waited some more. After about an hour and a half of waiting, I found out that the judge, attorneys, and DA were in judge’s chambers downstairs. Here’s where this whole situation gets really whacky: The DA wanted the plea deal, the defense was wholeheartedly considering it, and the judge was willing to approve it. Then MALDEF and the Department of Justice (DOJ) called Crystal Dillman (self-titled “fiancee” of Luis Eduardo Ramirez Zavala) and Ramirez Zavala’s mother in Mexico who used an interpreter. Both Momma Ramirez and Dillman fought against the plea deal because it wasn’t harsh enough. Well, I’ll be ..
Since WHEN does the American judicial process get halted by racist, ethnocentric brown supremacy groups? Why is the DOJ working WITH anti-American, racist groups? Back to the courtroom: we waited still for the hearing to start, or to get word of any plea bargains being accepted. Finally, the ten-minute hearing began. The judge told the DA he has several items to answer, within ten days, and the judge named off several numbers that apparently correlate to a packet of papers they had. I found out later on that some of those numbers included the DA handing over evidence to support the charges of homicide and ethnic intimidation. The judge will also consider severing the trials, so they might be tried separately. We then went out into the hallway, where a slew of reporters with cameras waited for the teens to be led out of the courtroom. Once the boys had passed, the reporters asked some of us to interview on camera. My friend, Debby Rabold gave striking interviews with several of them. I spoke to Bob Reynolds from WNEP. Much to my surprise, they actually included some of what I said! LOL!
BREAKING NEWS: Judge considers charges, separate trials for 3 accused in Shen beating
During a hearing Thursday, three teenagers charged in connection with the fatal beating of an illegal Mexican immigrant in Shenandoah placed their fate in the hands of Schuylkill County President Judge William E. Baldwin.Brandon J. Piekarsky, 17, and Colin J. Walsh, 17, both of Shenandoah Heights, and Derrick M. Donchak, 18, of Shenandoah, want Baldwin to dismiss charges against them or, alternatively, to have them tried separately in connection with the beating of Luis Eduardo Ramirez Zavala. At the end of the 10-minute hearing in a packed courtroom — preceded by almost two hours of conferring by the judge and lawyers on each side — Baldwin took the defendants’ requests under advisement but did not indicate when he would rule. Baldwin did order prosecutors to provide more information to the defendants’ lawyers about the exact acts they allege the teenagers committed, the exact words they allege the young men said and the exact nature of any alleged agreement by the trio to commit any crimes.
The commonwealth has not articulated its theory well enough,” Baldwin said in explaining why he ordered prosecutors to provide that information. Neither prosecutors nor the defendants presented any testimony during the hearing. Prosecutors offered into evidence the transcript from the Aug. 18 preliminary hearing, as well as the autopsy and supplemental medical reports on Ramirez, as their case at this stage, and the defendants did not object to Baldwin considering any of those. District Attorney James P. Goodman, the defendants and their attorneys — Frederick J. Fanelli, Pottsville, Roger Laguna, Harrisburg, and Jeffrey M. Markosky, Mahanoy City — all declined to comment on the case after the hearing.The three defendants have alleged the evidence against them is insufficient to support the charges. Also, they have alleged that if the judge finds the evidence sufficient, they should be tried separately; currently, prosecutors have consolidated their cases and plan to try them together. Schuylkill County detectives allege the three, along with a fourth teenager who is charged as a juvenile, beat and yelled racial epithets at Ramirez, 25, of Shenandoah, on July 12. Ramirez died two days later at Geisinger Medical Center, Danville, as a result of the beating, detectives said.Piekarsky and Walsh are charged with criminal homicide, aggravated assault, recklessly endangering another person, simple assault and ethnic intimidation. Piekarsky also is charged with criminal solicitation/hindering apprehension or prosecution and purchase, consumption, possession or transportation of liquor. Magisterial District Judge Anthony J. Kilker, Shenandoah, dismissed first- and second-degree murder charges against Piekarsky and Walsh at the conclusion of their preliminary hearing, leaving third-degree murder as the most serious homicide charge remaining against them. Donchak is charged with aggravated assault, simple assault, recklessly endangering another person, criminal solicitation/hindering apprehension or prosecution, ethnic intimidation, corruption of minors, purchase or consumption of alcohol by a minor and selling or furnishing alcohol to minors. All three are free on bail pending further court action.The Shenandoah Valley school board approved homebound instruction for Piekarsky and Walsh as directed by court order during a special meeting Sept. 10. Shenandoah Valley solicitor Michael A. O’Pake said outside the hearing Thursday that the district was providing education to Piekarsky and Walsh and that he has heard no complaints on the matter. The case has focused national attention on Shenandoah and the issue of legal and illegal immigration. On Thursday, several groups in favor of immigrants’ rights as well as regional opponents of illegal immigration attended the hearing

How can this be a Mockery of Justice, when it is the responsibility of the prosecution to provide the proof of evidence to ensure guilt?? Seems the Justice system is working the way it was intended, Innocent until PROVEN guilty. To bad you can't understand that.

Charges may be lessened or even dropped simply due to lack of evidence. Evidence is what is needed to convict a person of a crime, without evidence what else can they do??

Courtroom testimony?? from articles that limited what was described!! What is so wrong with using Mrs. Garcia's eye witness reports, she had no problem spouting about on the web or in the news. You want to blame someone for loosing this case for your side, blame Mrs Garcia for telling the truth. Funny how the truth comes out and you fail to want to believe it.

I have not spun anything, you failed to include Mrs Garcia's eye witness reports, which I am pretty sure were used in the case. Because you fail to recognize all the evidence your judgment in nothing but racial prejudice that is biased and lacks the true meaning of the Rule of Law.

But keep spinning if it makes you happy.

The facts are, the poor young father is dead and his children will not have him home for the holidays. In the meantime you advocate the perpetrators should get off scot free. Horrible!

You know what's really sad about all of this? I went to the saveshenandoah.com discussion board to find a post called "Free the Three", referring, of course, to the three teens. It was a post calling all those interested to arrange for carpools to Pottsville, so they can offer their support for the boys as they go to the hearing with the judge to hopefully get the charges dropped, or the case dismissed.

Crazy!!!

It's crazy, because the very same people were the ones posting on PA Pundits, with statements like "This was a terrible tragedy, of course" and "I don't condone that type of action against anyone" and "What the boys did was wrong, and they should pay for their crimes". It's crazy, because now they are in sharp contrast with these statements, saying that the charges should be dropped. What caused such a turnaround?

I think they never really changed their tunes, they're just showing their true colors, thinking no PROs would visit the Save Shenandoah website or take time to read some of the posts.

There is none so far, you have taken information from articles that have limited the information. Nothing has been my opinion, I have pointed out the actual information you wish to deny, the eye witness testimony from Ramirez own friend whom he was with all that afternoon. You wish to blame someone for this case loss, blame Mrs Garcia for opening her mouth.

SaveShenandoah is linked to the racist hate group Voice of the People. These are the same people who are involved with the angry demonstrations in Hazelton. They are linked to Diggers Realm Dan Amato, and others. I ve written about them before. They have made it their mission to let these jocks go scot free. They have spun this case to make the victim the criminal. They demonize anyone who tries to bring justice to the case. They even convinced the local mayor to resign.

In a six-hour preliminary hearing, Joseph Benjamin Lawson Jr., 17, testified he and the five others in the group drank liquor in the woods before going to the Polish-American Fire Company block party, where they argued with a firefighter about ''messing around'' with other football players.

All three of the accused played on Shenandoah Valley High School's football team last year. Donchak was the quarterback. Lawson testified that, at the block party, Donchak was especially angry.

As they walked to Donchak's house, he testified, they came across Ramirez and Dillman's half-sister, Roxanne, 15, at the park. According to Lawson, another teen, Brian Scully, who has not been charged, said to the girl, ''Isn't it a little late for you to be out?''

The girl didn't answer, but Ramirez replied in Spanish, and Scully replied, ''This is Shenandoah, this is America, go back to Mexico,'' and used racial slurs. The two began fighting, Lawson said.
Donchak hurried to join in, Lawson testified. Ramirez went down and the others stood around him, kicking him to the head and torso, Lawson said. But it was after Ramirez got up, while fighting with Donchak, that Lawson said Walsh ran up and sucker-punched him in the face.

Ramirez fell to the ground with such force his head bounced off the macadam, leaving him unconscious. Then Piekarsky administered a final kick to the head, Lawson said.

Boy that sure looks like 6 hours of testimony??!! Like I said, the media limited what it wanted to in the information it released about the testimony. You need to add in Mrs Garcia's information to get a clear picture, as I am sure that is what the defense has done and why the prosecution and your side is all up in arms right now. Gather all the information and factual evidence before you make judgment, something you have yet to correctly due.

I would like the link to this exact wording, otherwise I believe you made this part up "and used racial slurs" as I have yet to find where Lawson stated exactly that.

Unfortunately the racist hate group Voice of the People has descended down on this poor community and and negatively influenced the town. They even convinced the Mayor to resign.
How unfortunate.
I am hoping that justice will be served and the perpetrators of this crime be punished to the fullest extent of the law.
That way, Hate Crimes like this and the one in Long Island will never, ever happen again!

Friend of Mexican Immigrant Beaten to Death in Pennsylvania Gives Eyewitness Account of Attack

Luis Ramirez, a twenty-five-year-old Mexican immigrant, was beaten to death last week by a group of teenagers in Shenandoah, Pennsylvania. He was walking home last Saturday night when six white high school students brutally beat him while yelling racial slurs. Despite eyewitness testimony, no charges have been filed. We speak with Arielle Garcia, a friend of Ramirez who witnessed the attack.

AMY GOODMAN: We turn now to Shenandoah Valley in Pennsylvania. Luis Ramirez was a twenty-five-year-old Mexican immigrant who was beaten to death last week by a group of teenagers in Shenandoah, Pennsylvania. He was walking home last Saturday night when six white high school students brutally beat him while yelling racial slurs. When one of Ramirez’s friends tried to stop the beating, one of the teenagers said, “Tell your Mexican friends to get out of town, or you’ll be laying next to him.” Despite eyewitness testimony, no charges have been filed as yet.

Ramirez came to the United States six years ago. He was the father of two children. He was engaged to Crystal Dillman, who grew up in Shenandoah.

We called the district attorney investigating the case, but he declined to join us on the program and said he had no comment.

I’m joined right now by Arielle Garcia, a friend of the couple who was an eyewitness to the attack on Luis Ramirez. She’s a high school senior in Shenandoah. We welcome you, Arielle, to Democracy Now!

ARIELLE GARCIA: Hi. Thank you.

AMY GOODMAN: It’s good to have you with us. How old are you?

ARIELLE GARCIA: I’m seventeen.

AMY GOODMAN: And what year are you in high school?

ARIELLE GARCIA: I’m a senior.

AMY GOODMAN: Can you tell us what happened, not this past Monday night, but the Monday before that? What happened to Luis Ramirez? Where were you?

ARIELLE GARCIA: He was at our house all day that afternoon. And it was around maybe 11:00, he asked us to take him uptown to drop him off, whatever, he was going to go home. So, we leave him at the Vine Street Park, and we drive away, Victor and I, and about two minutes later he called us and told us to come back, that people were beating him up. So we get back as fast as we could. And when we get there, he was—like the fight was over, like the boys were walking away, but they were still screaming like racial slurs, like “Go back to Mexico!”

And so, Victor and I ran up to Luis, and we said, “What happened?” But he was so mad, he wasn’t really talking to us. And those kids kept yelling stuff, and he went back, and the kids turned around, and the fight started again. So Victor, my husband, tried to like stop the fight. He tried to get the kids off of Luis, but kids were trying to fight my husband. So my husband got the kids off of him, and we couldn’t stop the fight between Luis and the—but next thing we know, Luis was on the floor. And so, me and Victor, we ran up to his side, and we were at his side. We were trying to wake him up, and the kids are still like kicking him and kicking him. And somebody—I don’t know who, but they kicked him like in the left side of his head so hard that that’s what killed him.

AMY GOODMAN: Now, where were you and your husband exactly as this part of the fight took place?

ARIELLE GARCIA: We were right by him on the floor. We were like kneeling by his side, trying to wake him up when they kicked him.

AMY GOODMAN: Did you know his attackers?

ARIELLE GARCIA: Yes, they’re in my class.

AMY GOODMAN: How many were there?

ARIELLE GARCIA: Six or seven.

AMY GOODMAN: You knew all of them?

ARIELLE GARCIA: Yeah.

AMY GOODMAN: Can you name them?

ARIELLE GARCIA: I don’t think I’m allowed to name them. I’m sorry.

AMY GOODMAN: Did you tell the police who they were?

ARIELLE GARCIA: Yes.

AMY GOODMAN: And what did the police say? Did the police show up that night?

ARIELLE GARCIA: Yeah, they showed up. First, the ambulance did, and they took our friend to the hospital. And about five minutes later, the police came, and I guess they were looking—I mean, we kept telling them where the kids ran, but they didn’t—they didn’t run towards there. I mean, they kind of stayed where it all happened. And I told them the names and everything.

AMY GOODMAN: And, well, this was more than a week ago. Have they been investigating since?

ARIELLE GARCIA: Yeah. And like, still nothing.

AMY GOODMAN: Why did they say—when you showed them the direction that the kids had run, why did they not go after them at the time?

ARIELLE GARCIA: I don’t know. They told me that it wasn’t their priority right now.

AMY GOODMAN: What do you mean, “their priority”?

ARIELLE GARCIA: Yeah.

AMY GOODMAN: Where was your friend at this point? Where was Luis Ramirez?

ARIELLE GARCIA: He was gone. He was in the—on his way to be [inaudible].

AMY GOODMAN: What was their priority? Did they say that to you?

ARIELLE GARCIA: No. They were pretty rude, some of them. Not all of them, but most of them were pretty rude to me.

AMY GOODMAN: What do you mean they were rude?

ARIELLE GARCIA: Like, I told them where the kids ran, and they wouldn’t go after them, and they told me that “Somebody said there was someone with a gun here, and we have to search your car.” And they searched Victor, like they put his hand behind his back, and like they put him against—

AMY GOODMAN: Victor is your husband?

ARIELLE GARCIA: Yes.

AMY GOODMAN: The boys ran off. Was it all boys?

ARIELLE GARCIA: Yeah.

AMY GOODMAN: Were they white? Were they Mexican?

ARIELLE GARCIA: Yeah, they were all white.

AMY GOODMAN: All white, and you know them all?

ARIELLE GARCIA: Uh-huh.

AMY GOODMAN: Have you seen them in school? Or school is out, so you haven’t seen them since.

ARIELLE GARCIA: Yeah, no, I haven’t seen them. I mean, we’ve seen one of the kids. He was like playing—

AMY GOODMAN: If you could talk as loud as you can, Arielle, it’s a little hard to hear you because of the crackling of the phone.

ARIELLE GARCIA: Oh, OK.

AMY GOODMAN: Speak right into the phone.

ARIELLE GARCIA: OK. Yeah, we have seen one of the—like one of the guys recently. We saw him in the backyard of his house playing, as if, you know, like nothing happened. It is frustrating. Our friend is dead and these kids are living life. That kind of frustrates us, because our friend’s dead, and these kids are like living life. It just frustrates me, like they can live without feeling guilty or anything. I just hope that the correct charges are pressed against them.

AMY GOODMAN: Did you speak to any of these kids, since you knew them, in the midst of the fight or afterwards? Did they say anything to you?

ARIELLE GARCIA: Yes. After the fight, I ran after one of them, and I said, “Hey!” I said, “Why did you do this to my friend? You killed him.” And they said—he says, “No, no, I didn’t kill him. He’s still breathing.” And I said, well—and I smelled like—I smelled alcohol, and I said, “Oh, you’re drinking?” And he said, “Yeah.” And he said, “Don’t say our names. I’m out of here.” And he ran.

AMY GOODMAN: He said, “Don’t say our names”?

ARIELLE GARCIA: He said—yeah, he said that.

AMY GOODMAN: Do you know why they attacked Luis?

ARIELLE GARCIA: Do I know? No. I mean, Victor and I weren’t there when it all started. But like I said, when we got there, it was all racial. Everything.

AMY GOODMAN: What do you mean, it was racial?

ARIELLE GARCIA: They were screaming racial, like “Get out of here, Mexican, whatever. Go back to where you came from.” I mean, they were saying bad stuff that I can’t say over the phone.

AMY GOODMAN: We’re showing pictures right now. For our radio listeners, you can go on our website at democracynow.org to see pictures of Crystal, Luis Ramirez’s fiancee, and pictures of Luis, as well, and their children.

So they were shouting racial epithets. They were—what is the atmosphere in Shenandoah? What is the attitude to Mexican immigrants?

ARIELLE GARCIA: I think it’s—most of the time, it’s OK. But there are times when there are racial slurs. I mean, with my husband, I’ve been with him four years, and like, I’m telling you, there are many times that I’ve heard people scream racial slurs to him. You know, like I was pregnant with my son, and they told me, “What’s that in your belly? Another person I’m going to have to pay for? Another Mexican on welfare?” Like stuff like that. It’s disgusting.

AMY GOODMAN: What do you want to see happen in this case? And how is Crystal? How is Crystal Dillman, Luis’s fiancee and mother of his kids?

ARIELLE GARCIA: She’s doing OK, but she’s pretty upset and she’s frustrated that nothing has been done yet. She wants justice for her family. And we do, too. We want justice for our friend. I feel like that wasn’t his time to die. I feel like those kids should be—they should be treated as adults in this case. They should be treated as adults that committed a homicide. I don’t understand why it’s being put off here.

AMY GOODMAN: Luis’s body has been sent back to Mexico?

ARIELLE GARCIA: Yes.

AMY GOODMAN: To his family?

ARIELLE GARCIA: Yes.

AMY GOODMAN: What has been his family’s reaction? And where does he come from in Mexico?

ARIELLE GARCIA: I don’t know the town. I don’t know. It begins with a “G”. But he—his body was sent back to his mother, and she was—when she found out, she was hysterical. I mean, Crystal told me that she was screaming on the phone, and she didn’t know—she didn’t understand, and she didn’t want to believe it. And he’s arriving there today, actually. No it does not, as a coroners report has been submitted, there is no records of this case in the public eye, only portions in an article. At no time does the article state that the report says that the kick in the head killed Ramirez, it only states that blunt force trauma to his head is what killed him. That means it may have been the kick, it may have been the hit to the head by a fist with a piece of metal in it, or it may mean when Ramirez hit his head on the ground. There is no definitive proof that the kick is what killed him. The more you state that as the fact Dee the more I will harp on you, the more I will make you look foolish.

I never said the judge was dropping the case, and MURDER charges where dropped when Class 1 & 2 was dropped, Class 3 is involuntary Manslaughter, not MURDER. But then you don't understand the dynamics of our laws.

Man accused of sex with girl, 12

Deputies say she and the suspect had intercourse various times over several months.

BROOKSVILLE - A 26-year-old Brooksville man was charged Tuesday with 20 counts of sexual battery on a 12-year-old girl.

The Hernando County Sheriff's Office accused Eduardo Zavala, of 9030 Grande Av., of carrying on a sexual relationship with the girl shortly after the two met earlier this year. The victim told authorities that she and the suspect had intercourse numerous times over a period of several months.

According to authorities, the victim said she informed the suspect of her age, and both agreed to keep their relationship secret from her parents. The victim said that at one point the suspect asked her to marry him and return with him to Mexico, where he was born.

A witness provided printed copies of e-mails between the suspect and the victim that tended to confirm the relationship between the two, authorities said.

On Monday, written journals and a diary detailing the relationship were turned over to the Sheriff's Office.

Authorities suspect that Zavala, who works as a roofer, is possibly an illegal immigrant with no permanent ties to Hernando County or the United States.

Zavala was being held in the Hernando County Jail on $200,000 bail.
