Russell Pearce, the Arizona State Senator who authored SB1070, is no-where-near finished with his attempts to "take back his country state by state" from the "invaders". He has another bill pending in the state legislature that would go even further to cause fear and panic in Latino and migrant communities - by pitting schools against the families they serve.

Senate Bill 1097 would create the following mandates on the Arizona Department of Education (ADE) and school districts:
1. Requires ADE to collect data on students enrolled in Arizona school districts who cannot demonstrate proof of legal U.S. residence.
2. Requires ADE to annually submit a report to the Governor, the Speaker of the House of Representatives and the President of the Senate and a furnish a copy to the Secretary of State which includes:
a) summary of the collected data on a district by district basis;
b) research on the adverse impact of the enrollment of students unable to show proof of legal residence;
c) total estimated total cost to Arizona taxpayers for their education; and
d) the total estimated cost to Arizona taxpayers for the education of students who are not U.S. citizens.
3. Authorizes the Superintendent of Public Instruction to withhold a school district’s state aid apportionment for non-compliance with the requirements related to data collection for students who cannot demonstrate proof of legal U.S. residence.

Got that? This is the next step in Operation Wetback 2010. Pearce's goal is to make the environment in Arizona so toxic for migrant families that they flee.

He has stated this outright:
“My personal background in law enforcement has given me a unique and in-touch perspective with the needs and hazards experienced by rank-and-file police officers and the threats to our citizens. Closing our borders is a must; however it must be coupled with interior enforcement. Attrition by enforcement. I cannot stand by and be a spectator to the death, maiming or damage to another police officer, citizen or taxpayer by an illegal alien because we refuse to enforce our laws and fail to put America and Americans First.”

As I wrote in a previous post, don't let these conservative pharisees fool you: they love to complain about overcrowded schools and blame "illegals" but they won't do anything constructive to make sure our school systems are fully funded in the first place. They don't believe in government, period.

While the outrage being poured out nationally in response to SB1070 is a good (and much-needed) thing, it's also defense. We have to be proactive and fight these un-American initiatives before they are signed into law by nativist Governors. Please speak out against SB 1097 - our schools should remain safe institutions of learning, not another venue that provides opportunity for an ICE raid.

Contact Governor Brewer and ask for her veto if it passes the leg
Alert the media as to why this is a harmful step for Arizona
Educate your family & friends on Russell Pearce's Operation Wetback 2010
Vote against any candidates listed as members of the Arizona Republican Party

Just imagine how this will play out if this heinous bill passes:
1. School's request citizenship status. Out of 100 children, 20 cannot provide proof of citizenship. Of those 20, 5 are citizen children of undocumented workers, 5 may not have current paperwork but are here legally, 5 are in legal pending status, disputing their current status; 5 are in the country illegally. status. Some may have no status.
2. The schools send their reports to ADE, including the names and addresses of the 20 out of every 100 with no current legal paperwork.
3. ADE submits this report to the Governor, Speaker, Pres of Senate.
4. Govt Officials provides report to local sheriffs (per 1070) and the Sheriffs' offices go to the homes of all the families without paperwork.
5. Sheriffs Offices go to each home,request current paperwork and send each family to ICE Detention.
6. ICE imprisons each family in ICE Detention Centers until their cases come to court. All families are deported, regardless of whether the families are disputing their current status or not.

NEW ICE DETENTION CENTERS ARE BUILD IN AZ TO HOUSE THE +600k Individuals in Arizona whose status is undocumented, pending or disputed.

This MASS DEPORTATION OVER 4 - 5 YEARS IS CALLED "ATTRITION THROUGH ENFORCEMENT."

FOR SB1070, the scenario will play out like this:

1. 100 Latinos are standing near Lowes. A White Conservative believes they are "illeegals" looking for work. They call police to report them.
2. The police arrive and ask 100 Latinos for their proof of citizenship. All stand in line in cuffs waiting to be processed.
3. Of the 100, 60 are citizens and have drivers licenses. They don't have a strong accent so the police release them after an hour. 20 are citizens but do not have a driver's license on them or their birth certificate. 10 are undocumented but are in the process of challenging their status in immigration courts. 10 are undocumented. All 40 are detained.
2. From 4 - 24 hours, 20 have their families bring their driver's license, passport, and/or birth certificate.
3. The other 20 are sent to Detention Centers, regardless of whether they are disputing their status or not. They wait in jail until their court date.
4. Since so many people are in progress of deportation, courts get extremely backlogged and court dates are pushed out to 6 months, to 12 months. They stay in limbo status since they have not been charged.

Arizona can pass race base laws, pass Birthers laws, pass no permit conceal weapons laws and the state can continue to boycott Martin Luther King Day, well the rest of the Country can boycott the state of Arizona and spank them where it hurts them the most their pocket book. Their phony patriotism is sickening, they are just racists going by another name. We all know you are just itching to put a sheet on their head? Let’s face it the Republicans had eight years to deal with health care, immigration, climate change and financial oversight and governance and they failed. It appears that the Republican Party is only good at starting wars (two in eight years, with fat contracts to friends of Cheney/Bush) but not at winning wars as seen by the continuing line of body bags that keep coming home. The Republicans party will continue turned inward to their old fashion obstructionist party (and their Confederacy appreciation roots) because they continue to allow a small portions (but very loud portion) of their party of “birthers, baggers and blowhards” to rule their party. I will admit that this fringe is very good at playing “Follow the Leader” by listening to their dullard leaders, Beck, Hedgecock, Hannity, O’Reilly, Rush, Savage, Sarah Bailin, Orly Taitz, Victoria Jackson, Michele Bachmann and the rest of the Blowhards and acting as ill programmed robots (they have already acted against doctors that perform abortions). The Birthers and the Tea party crowd think they can scare, intimidate and force others to go along with them by comments like “This time we came unarmed”, let me tell you something not all ex-military join the fringe militia crazies who don’t pay taxes and run around with face paint in the parks playing commando, the majority are mature and understand that the world is more complicated and grey than the black and white that these simpleton make it out to be and that my friend is the point. The world is complicated and people like Hamilton, Lincoln, and Roosevelt believed that we should use government a little to increase social mobility, now it’s about dancing around the claim of government is the problem. The sainted Reagan passed the biggest tax increase in American history and as a result federal employment increased, but facts are lost when mired in mysticism and superstition. For a party that gave us Abraham Lincoln, it is tragic that the ranks are filled with too many empty suits and the crazy Birthers who have not learned that the way our courts work is that you get a competent lawyer, verifiable facts and present them to a judge, if the facts are real and not half baked internet lies, then, and only then, do you proceed to trial. The Birthers seem to be having a problem with their so called “facts”. Let’s face it no one will take the Birthers seriously until they win a case, but until then, you will continue to appear dumb, crazy or racist, or maybe all three. I heard that Orly Taitz now wants to investigate the “Republican 2009 Summer of Love” list: Assemblyman, Michael D. Duvall (CA), Senator John Ensign (NV), Senator Paul Stanley (TN), Governor Mark Stanford (SC), Board of Ed Chair, and Kristin Maguire AKA Bridget Keeney (SC), she wants to re-establish a family values party, that’s like saying that the Catholic Church cares about the welling being of children in their care, too late for that.

Challenge away. I have visited Ultimas blog before. I've posted many times. I read his letter to our President.
Ultima and I go way back and have known each other for years. We were both commenters on an Immigration discussion board back in 2006/2007. I started my blog before his. He patterned his after my blog. We both started out with zero viewers.
I do visit from time to time. We even email each other from time to time. We are NOT enemies. We just disagree on the Immigration issue. I believe in Comprehensive Immigration Reform. He believes in Mass Deportation through Attrition through Enforcement which I find despicable.

Now stick to topic. This was your one chance to go off topic and be published.

Do you agree with Attrition through Enforcement and the jailing of children and families in Detention Centers. That is what will happen with both of these bills and that is what White Supremist Russell Pearce wants!

Actually she has this backwards:
Dee erroneously equates "attrition through enforcement" as "mass deportation".

Mass deportation would be something like: "Every illegal has two hours to appear at the train station or bus terminal with his or her belongings. Special buses and trains will be available to return you to your homeland. Any assets you have other than what you can carry will be confiscated and sold to defray the cost of your transportation to your homeland. Failure to appear will be a felony and those subsequently apprehended will serve two years working on border infrastructure before they are deported."

Dee is simply using hyperbole. She cannot even demonstrate that in 4 or 5 years, all illegals will be gone as a result of attrition through enforcement.

Here is what I actually proposed many times and which, at one time or another, Dee indicated she agreed with at least some part of this approach attrition through enforcement.

1. Require all employers of illegals to re-advertise their jobs offering a living wage with a hiring preference for citizen labor.
2. A living wage is defined as the prevailing wage, certified by local unions, for each type of job and the level of experience and skill of the applicant.
3. If an employer can present irrefutable evidence that he has made a good faith effort to hire American workers to no avail, he may then consider retaining or hiring foreign workers who can pass a background check and a medical exam.
4. Foreign workers who survive this process will be issued green cards and tax identification numbers.
5. Those who fail this test will be detained and brought before an immigration judge to determine whether they should be allowed to stay even though they no longer have job.
6. The bases for a favorable immigration decision could include evidence that the individual: is learning English; has renounced any dual citizenship or dual allegiance to a foreign government;is socially integrated and culturally and linguistically assimilated; has children over the age of 5 in school learning English and civics; has never displayed the flag of a foreign nation instead of the U.S. flag; and has testimonials from employers and co-workers.
7.Family separation is disallowed as a basis for a favorable immigration decision.
8. Parents under a removal order must take their minor children with them regardless of their citizenship or be charged with child abuse.

There are a number of alternate scenarios that have as much validity as Dee's conjecture.

For example, the five who are citizen children of illegals are nevertheless citizens and should be reported as such.

The seoncd five do not have their documents with them could be counted as illegal temporarily and then the record can be corrected as soon as the documents are produced. Believe me, an American birth certificate is worth more than its weight in gold and the family would always keep it is a safe place and would quickly seek a replacement if it is lost or misplaced.

The third five cannot be considered to be here legally if they do not have current paperwork.

The answer to this whole scenario is to elaborate the reporting to include the vaious categories Dee has indicated. That would make a better report than a simple yes or no on legal status. It would be a good idea to also add the parents' status. This could be the beginning of a registration process for illegals.

I have also long been an advocate of more immigration judges or justices of the peace in the communities or areas where the illegal population is known to be significant. There should be ample publicity to indicate the criteria that will be used in judging immigration cases. Allowing only one week for appeal will get the illegals out of detention and on their way home. It is likely that the collection of data and submission of reports and any ensuing action would take at least a year, plenty of time for all to bring their paperwork up to date, assemble whatever case they can make for staying in the U.S., and correcting any errors in the reports. No need to take precipitate action without the facts.

It is clear that the argument here has little or nothing to do with the methods used. The argument is that no illegals other than hardened criminals should be subject to removal. This is basically an amnesty/open borders argument.

The challenge to those who oppose SB1070 is to propose alternate measures that will be effective in identifying and processing illegal aliens. The opposition refuses to make such proposals because they don't want any illegals removed.

E-verify is a less intrusive and legal altenative which if made mandatory by the federal government would obviate the need for more draconian state laws.

Wrong! This bill IS Promoting Mass Deportation of all those you call illeegals over a 4 - 5 year period. In AZ, they say they have 600,000 people plus their citizen children would equal 1M people. That would mean deporting 240K people per year. 20K per Month. Imagine the backlog in the detention centers. Imagine the backlogs in the courts.

Where you going to put them? They have to be processed. You know Arpaio is planning more extensive sweeps if this bill is passed. Think of all of the citizens in the roundups. His pink underwear, green bologna jails are already overcroweded.

Arizona will become a major prison industry. There will be so much backlog in prisons; entire families in jail. It will take months, years, to process all the cases. People will be in jail for years before they even hear the court cases. Think of the money spent jailing all of these people.

Of course it is Mass Deportation. Just because it doesn't happen on one quick train trip, but the process takes years, of wasted $$, time and lives.

Meanwhile, hundreds of thousand of latino citizens racially profiled and treated like 2nd hand citizens in this apartheid state.

wow, we are here debating immigration reform which I am pro immigration and legalizing people. What I am confused about it why aren't we just talking about ur basic rights in the constitution. The 4th amendment. Am I wrong? - Doesn't this law violate our constitutional rights? the 4th amendment says the law officer cannot stop you on a hunch.

You are absolutely right. This bill violates are Civil Liberties and the 2nd Ammendment.

Senator Menendez said it well:
“This is a slide back on the rights of each and every American. Arizona has become a ’show me your papers’ state’,” said Senator Robert Menendez, Democrat of New Jersey. “I read the Arizona law, and it’s just replete with the type of broad descriptions that invite discrimination, that invite racial profiling, that invite violations of constitutional rights and civil rights.”

1. Secure Borders
2. Sanction Employers
3. ALLOW THEM TO GET IN LINE (if felony free) and ALLOW THEM TO APPLY FOR CITIZENSHIP. This takes the criminality out of the equation. Just like when they changed the Jim Crowe laws.
They can come and sit in the front of the bus and pay all the taxes we pay.
